Charlotte's practice focuses on international investment treaty arbitration and international commercial arbitration. Charlotte has represented international companies and foreign governments in arbitrations under the leading institutional and ad hoc arbitration rules, including UNCITRAL, ICC, and AAA/ICDR, and in arbitrations administered by ICSID and the PCA. Charlotte's experience includes disputes in the renewable energy, oil & gas, mining, construction, technology, and biotechnology sectors.

Charlotte's practice also focuses on international disputes before US courts, including the enforcement of arbitral awards and foreign judgments against sovereigns and commercial entities.

Arbitration Experience

  • Representing the Sultanate of Oman and defeating multi-million dollar claims by a Saudi investor pursuant to the OIC Agreement concerning a construction project.
  • Representing two investors in an UNCITRAL (ICSID) BIT claim against an Asian State in connection with their investments in the renewable energy sector.
  • Representing a Big Four tech sector client in a San Francisco-seated ICC arbitration arising out of breach of a Delaware law confidentiality agreement.
  • Representing a major multinational technology company in an ICC arbitration arising out of an indemnification provision of an acquisition agreement.
  • Representing a celebrity estate in AAA arbitration governed by New York law arising out of the termination of a representation agreement pertaining to name and image.
  • Representing a contract research organization in an ICDR arbitration against a biotechnology company arising out of the development of a vaccine product.
  • Representing a significant construction and engineering joint venture contractor in an ICC arbitration arising out of a multi-billion-dollar LNG project off the coast of northern Australia.

Enforcement Experience

  • Representing a Canadian mining company in multiple US courts to enforce a US $1.4 billion investment treaty arbitration award against Venezuela.
  • Representing two individuals in the enforcement of their US $2.79 billion judgment against a foreign sovereign.
