About

Khaled Dadi advises on a broad range of commercial contracts, such as contracts regarding the supply or purchase of products and/or services, the appointment of commercial agents, the organization of a distribution- or franchise network and other types of partnerships.

Besides his commercial contracts practice, Khaled has vast experience in the field of IT-, competition-and privacy law. In addition, he frequently teaches courses on the legal aspects of international trade.

Khaled has e.g. been involved in major strategic IT / Outsourcing litigation cases for high-profile clients, acting on behalf of both IT-vendors and their customers. The nature of the disputes range from IT-licensing disputes, failed IT projects and specific performance disputes.

Together with two other law firms, Khaled advised the EU Commission on the development of model clauses for cloud services to financial institutions. In doing so, Khaled worked with various EU stakeholders such as ENISA and EBA to develop these model clauses.

In addition to his work for clients, Khaled is heavily involved in pro bono work for NGO's such as Solidaridad, Plan Nederland and Unicef. Khaled has also been involved as lecturer in the "Know your rights" project. This project is designed to empower refugees by educating them on their rights. Khaled war responsible for the course on contract law.

EXPERIENCE

  • Advising a large Dutch Telco operator on the restructuring of its partner network.
  • Advising a large Dutch bank on a dispute with one of its IT-vendors and conducting legal proceedings in respect of this dispute. The dispute pertained to the questions whether the bank had - compared to the actual deployment - failed to procure sufficient licenses.
  • Advising an international bank on the development of an online platform for processing bank guarantee applications through the use of blockchain technology.
  • Advising the EU Commission on the development of model clauses for outsourcing to the cloud by financial institutions. As part of the instruction, we were asked to ensure that the models clauses were EBA compliant.
  • Drafting various IT-outsourcing/software development/licence agreements and conductions negotiations in this respect.
  • Advising an international IT-vendor on a dispute with one of its customers and conducting legal proceedings in this respect. The dispute pertained to an allegedly failed IT-project.
  • Advising one of the largest Dutch insurance companies on the implementation of a franchise network and drafting all relevant agreements.
  • Advising an international supplier of (encryption) technology designed to protect amongst others content, cars, IoT devices etc. The (continuing) advice pertains to all legal aspects of the procurement- and sales process, ranging from license-, sales-, partnership-, R&D- to procurement agreements as well the legal implications of security breaches and associated liability issues.
  • Advising a large Dutch bank on a dispute with one of its IT-vendors and conducting legal proceedings in respect of this dispute. The dispute pertains to the questions whether the bank had - compared to the actual deployment - failed to procure sufficient licenses.
  • Advising an international IT-vendor on a dispute with one of its customers and conducting legal proceedings in this respect. The dispute pertained to an allegedly failed IT-project.

  • Advising a Telco operator on a dispute with one of its commercial agents. The disputed pertained to the termination of a commercial agency agreement and the indebtedness of goodwill.
  • Advising a large Dutch Bank on the set up of a Carbon Reduction set-off scheme by drafting and negotiating contracts covering the entire value chain from the generation of Carbon Reduction Units by farmers, contracts with partners overseeing local projects and contracts with customers for the sale of Carbon Reduction Units.
