Mark Briggs delivers practical and commercially focussed advice in relation to complex construction and engineering disputes in the UK and around the world.

Mark regularly achieves excellent results for clients in high value disputes across many different industry sectors, including renewables, oil and gas, manufacturing, aerospace, healthcare and commercial property.

Mark acts for clients in arbitration (both ad hoc and under institutional rules), litigation, DAB, adjudication, mediation and other forms of ADR. Mark also regularly provides strategic advice on live construction projects – helping clients navigate issues and avoid disputes.

Mark was seconded to Wood plc from January to March 2020 as legal advisor, advising on contentious and non-contentious matters arising across Wood’s EMEA business.

EXPERIENCE

  • Advising an EPC contractor in relation to claims worth over GBP 110m arising from its construction of an offshore substation and related power connection works, which form part of a significant UK offshore wind project.
  • Providing strategic advice to a funder of green energy projects, in relation to various disputes across different wind farm projects in Scandinavia. Issues include delays caused by the COVID-19 pandemic, global supply chain disruption and defective works.
  • Successfully acting for a Pakistani LNG terminal operator in a London-seated LCIA arbitration worth in excess of USD 200m – a project of significant importance to Pakistan’s energy needs.
  • Successfully acting for a major US conglomerate in DAB proceedings, securing a GBP 50m award in relation to delay claims  arising from construction works on a South African power station.
  • Advising a major US contractor on a serial defect claim against a sub-supplier in relation to a major European offshore wind project. 
  • Representing a European developer in relation to various claims arising out of the construction of a transnational gas interconnector project. This project is a significant piece of infrastructure essential to securing and diversifying gas supplies in Europe.
  • Acting for a state-owned Chinese energy contractor in relation to delay, disruption and variation claims worth over USD 200m against the employer under an EPC contract for the construction of a power station in Vietnam.
  • Successfully representing a Chinese state-owned EPC contractor in Singapore-seated SIAC arbitration proceedings to recover unpaid retention sums in relation to the construction of a power station in Indonesia.
  • Advising a developer of solar power generation projects in relation to its entitlement to, and strategy for, terminating a framework agreement and EPC contracts for the construction of solar projects in Latin America.
  • Achieving a favourable settlement for a major UK contractor in relation to a long-running payment dispute with its subcontractor.
