About

Simon Murphy advises clients across a number of sectors and regulatory environments on large scale and strategically critical IT and commercial programmes. This includes outsourcing of IT and business processes, procurement of software products and services, software development, cloud services, datacentres, supply chain contracts and transitional services arrangements.

He typically works alongside each client’s commercial, operations and/or procurement teams to help establish innovative and legally sound contracting models. Simon is able to guide clients through its business case and strategy formation, execution of procurement and negotiation processes, and contract management and variations.

Since joining DLA Piper as a trainee solicitor in 2001, Simon has worked in the firm’s UK and Hong Kong offices, and has been active in successful international initiatives and projects. He also regularly provides training and facilitates interactive workshops on a range of commercial topics.

EXPERIENCE

  • Advising NHS Digital and DHSC on various transactions to procure and roll out suites of Microsoft product and services to over 1m users, taking a key role in the negotiation of commercial and data privacy terms, and creating the terms of licence participation for various Trusts and health organisations.
  • Advising NHS Digital to establish an innovative assurance, procurement and contracting model known as GP IT Futures to replace an established contract vehicle for the GBP500m funded GP IT market.
  • Advising NHSX / NHS England to put in place a number of emergency contracts in response to COVID-19 with various private sector suppliers and other publicly funded organisations for the supply of software development and training resources, and to draft associated policies.
  • Advising a large international private sector supplier for its supply of datacentre services to the public sector, with a focus on negotiating the service levels and liability terms.
  • Advising a global insurance provider on the GBP600m outsourcing of its IT infrastructure and functions, developing and negotiating the contract, the governance arrangements, and providing associated advice on risks.
  • Advising a UK health and wellbeing services provider with regards to key supplier contracts for technology solutions to underpin delivery of its member services, including financial software and access to the provider network and associated claims management services.
  • Advising a leading UK building society in relation to a multi supplier IT transformation and negotiation of its key strategic mortgage originations solution platform contract.
  • Advising a leading airline and tour operator on implementing an IT led programme designed to support continued growth of the businesses, maximise customer revenue and increase efficiency savings comprising a suite of commercial arrangements which underpin the programme covering online reservation systems, arrangements with global distribution system providers, systems to manage aircraft maintenance, software solutions for ground operations, security vetting, customer contact centre services, in-flight retail solutions, white label websites for additional services, website terms and privacy policies, marketing campaigns and promotions, media buying arrangements, analytical services for online traffic, a licence for route scheduling software, the design, implementation and support of data science projects.
  • Advising an international hotel chain on agreements for the development and support of a key global CRM system by a China based supplier, supporting the client through the contract negotiation.
  • Advising a leading betting and gaming company in relation to key software development projects and the implementation of a HR recruitment platform.
