In the recent years, so-called joint bidding arrangements have drawn competition authorities' attention. In the Nordics, several joint bidding arrangements have been found in breach of applicable competition rules and are labelled as 'severe infringements', 'hard-core restrictions' and/or 'cartels'. On the other hand, joint bidding may be pro-competitive, highly desired and efficiency enhancing. Where to draw the line?
