All businesses that operate an online site or server where users can post content need to re-register their Digital Millennium Copyright Act (DMCA) agent designations with the Copyright Office.
This is a reminder to service providers that the US Copyright Office has adopted a new set of rules governing the registration and maintenance of designated agent information. The new rules require that to be eligible for safe harbors under Section 512 of the DMCA, all online service providers must electronically submit new designated agent registrations with the Copyright Office before December 31, 2017.
An online service provider that has not submitted a new registration via the electronic system by the deadline risks ineligibility for the notice and takedown safe harbor protections of Section 512 of the DMCA.
