DLA Piper represented Blue Diamond Growers (Blue Diamond), makers of Nut-Thins® crackers, defending it against a putative nationwide class action filed in the Eastern District of New York. The named plaintiff made allegations against Blue Diamond related to the marketing of their Almond Nut-Thins crackers. After more than a year of litigation, the court granted Blue Diamond's motion to dismiss the plaintiff's amended complaint in its entirety, with prejudice.
