Nate advises on US trade remedies, export controls, economic sanctions, the Committee on Foreign Investment in the United States (CFIUS) and related areas of national security and international trade laws. Nate has successfully litigated more than 100 cases and appellate proceedings involving US antidumping and countervailing duty laws before the US Department of Commerce, US International Trade Commission, Court of International Trade, and Court of Appeals for the Federal Circuit.  He also regularly helps clients successfully navigate the complex CFIUS process and national security issues involving investments and cross-border transactions. Nate has extensive experience with emerging technologies in the aerospace, defense, oil and gas, medical, transportation, semiconductor, consumer electronics and telecommunications industries.

He has helped hundreds of companies across various industries successfully resolve internal and government investigations and compliance issues involving these laws. Due to his extensive experience with the International Traffic in Arms Regulations (ITAR), Nate has been appointed by the Assistant Secretary of State for Political-Military Affairs to serve on the US State Department’s Defense Trade Advisory Group for four consecutive terms, most recently for the 2022-2024 session. He also advises companies on compliance with the Office of Foreign Assets Control (OFAC) sanctions and US export control laws.

Before entering private practice, Nate was an international trade specialist at the International Trade Administration of the Department of Commerce, where he worked on trade negotiations and trade agreement enforcement and compliance.

EXPERIENCE

CFIUS, EXPORT CONTROLS, AND SANCTIONS

Nate has over two decades of experience advising a wide range of companies and investors in the aerospace, defense, IT, materials, and advanced manufacturing industries on compliance with US export controls, sanctions, and national security laws. Recent representative matters include:

  • Helping an advanced semiconductor company to successfully obtain CFIUS clearance for investments by a range of non-US private equity investors
  • Assisting a medical device startup to successfully complete CFIUS review in connection with a series of private equity funding rounds
  • Advising a major US defense and aerospace manufacturer on compliance with ITAR, EAR, and sanctions laws in connection with its contracts with the Department of Defense and Foreign Military Sales customers
  • Successfully resolving a US government investigation of suspected ITAR and EAR compliance issues at an international defense company and advising company leadership on updates to policies, procedures, and existing Technology Control Plans to address the deficiencies and process gaps identified
  • Counseling a US information technology and cybersecurity company on internal investigations of suspected export control violations, voluntary self-disclosures, license applications, product classification, and compliance issues involving encryption, wireless, and networking technologies
  • Assisting a US cybersecurity provider with product classification, export control licensing, investigations, and voluntary disclosures arising in connection with its acquisition of a global information technology company
  • Advising a provider of commercial satellite launch services on compliance with the ITAR, EAR, and US economic sanctions
  • Assisting a leading financial institution in successfully resolving an investigation of suspected violations of US economic sanctions and anti-boycott laws by its various business entities

TRADE REMEDIES AND TRADE POLICY

Nate regularly represents companies in trade proceedings under US antidumping and countervailing duty laws, Section 232 of the Trade Expansion Act of 1962, and Section 301 of the Trade Act of 1974. He also works closely with Congressional staff, agency and company officials, industry associations, and other relevant stakeholders on legislative and policy initiatives related to US customs, trade laws, and trade agreements. Recent representative matters include:

  • Assisting a producer of advanced materials in connection with the enforcement of antidumping and countervailing duty orders by US Customs and Border Protection
  • Advising steel and aluminum industry companies on Section 232 and Section 301 tariffs and tariff exclusions
  • Counseling a US industrial equipment manufacturer on recent US supply chain certification requirements for imported information and communications technology and services (ICTS)
  • Advising a leading US energy producer on trade and investment aspects of the US-Canada-Mexico Agreement
