Brad Jennings’ practice focuses on the defense of pharmaceutical, life science, and medical device companies, including coordinated and multidistrict product liability litigation.

Brad advises pharmaceutical clients in the context of risk assessments focusing on artificial intelligence in product development and on compliance issues.  He has significant experience with expert witness development and dispositive motion practice.

EXPERIENCE

Representative of his experience are the following matters:

  • In re Zantac (Ranitidine) Products Liability Litigation, MDL 2924 (SD. Fla.): Member of co-national counsel team for Sanofi in MDL and state court litigation involving thousands of cancer claims and third party payor, medical monitoring, and consumer fraud class actions; obtained exclusion of MDL plaintiffs’ experts’ testimony on general causation, the largest Daubert victory for the defense in history (measured by the number of plaintiffs dismissed) (2022 WL 17480906 (S.D. Fla. Dec. 6, 2022)).
  • Representing a large pharmaceutical company in federal court in a commercial contract dispute related to contingency value rights resulting from a prior acquisition. 
  • Risk assessments on potential future litigation and government investigations related to anti-obesity medications as well as compliance, data bias, and explainability issues with artificial intelligence integration into medical device development.
