Lupe Laguna is an experienced litigator that represents clients in high-stakes, complex litigation involving a wide range of issues.  His experience includes consumer class actions, contract disputes, trade secret misappropriation, unfair business practices, fraud, various business torts, and antitrust.  He has represented clients as plaintiffs and defendants in state and federal courts, and in arbitration.  Additionally, while working for an international law firm in Los Angeles, Lupe worked in a pro bono capacity as a prosecutor for the City of Redondo Beach where he tried criminal cases to verdict.

Lupe previously served as a law clerk for the Honorable John J. Tharp Jr. of the U.S. District Court for the Northern District of Illinois.  He also served as an infantryman in the United States Marine Corps.  He deployed to Iraq twice with 3rd Battalion, 1st Marines, 1st Marine Division.

EXPERIENCE

Commercial Litigation 
  • Representing chemical manufacturer in multidistrict litigation involving claims of environmental contamination.
  • Represented angel investor in fraud action against company and its management. Obtained terminating sanctions against all defendants.
  • As lead counsel, represented financial services institution in financing dispute with commercial borrower. Obtained mandatory temporary restraining order and preliminary injunction ordering commercial borrower to identify the location of pledged collateral assets. Action ultimately resulted in $1.4 million judgment
  • Represented telecommunications provider in one of the largest California False Claim Act actions in California history. Examined more than a dozen key witnesses at deposition
  • Served as trial counsel for solar company in two-week jury trial relating to a trade secret and employment dispute
  • Represented autonomous vehicle developer in international trade secret misappropriation dispute involving complex spoilation and e-discovery issues
  • Represented international financial services company partner accused of billing fraud. Drafted winning summary judgment motion that defeated plaintiff's claims in full
  • Represented an independent Special Litigation Committee of a California corporation in connection with derivative claims brought against company board members
  • Represented insureds in dental malpractice Judicial Council Coordinated Proceeding. Drafted winning motion that defeated plaintiffs' effort to consolidate multiple bellwethers into a single trial proceeding 
Consumer Class Action Defense
  • Represented national bank in various consumer class actions challenging bank's implementation of the SBA's Paycheck Protection Program. All complaints were resolved on the pleadings stage
  • Represented national bank in novel consumer class action alleging violation of the Electronic Funds Transfer Act. Drafted winning motion to dismiss that resulted in full dismissal, with prejudice, of all class claims 
  • Represented global distribution company in consumer class action alleging violations of the Telephone Consumer Protection Act
  • Represented an international cosmetics company in the settlement of consumer class action claims relating to violations of state consumer protection law. 
White-Collar Criminal Defense/Internal Investigations
  • Represented global automakers in federal criminal grand jury and NHTSA investigations. Investigation resulted in no criminal charges being filed
  • Represented a packaged seafood company during federal criminal antitrust investigation and parallel civil proceedings
  • Represented fintech lender in state attorney general investigation relating to lending practices
  • Represented international apparel company in state attorney general investigation
