Eric Ortiz represents employers in complex state and federal employment litigation, including discrimination, retaliation, whistleblower, wrongful termination, trade secret, and non-competition claims.

Eric has successfully defended matters before the California Department of Fair Employment and Housing, California Division of Labor Standards Enforcement, California Employment Development Department and the US Equal Employment Opportunity Commission.

He also represents employers in wage and hour class actions and PAGA representative actions involving misclassification, unpaid meal and rest period, unpaid overtime, business expense reimbursement, wage statement and rounding claims. His experience includes both defeating class certifications and obtaining favorable class-wide settlements.

Eric regularly advises domestic and international clients regarding compliance with employment laws, including employee onboarding, discipline, termination, exempt/nonexempt classification, restrictive covenants, leave laws, WARN, diversity & inclusion programs, independent contractor classifications, and employee privacy matters. Eric's work also includes negotiating and drafting executive employment, compensation and separation agreements in conjunction with mergers and acquisitions.
