About

Brian M. Robinson represents a broad range of clients in class actions and complex commercial litigation matters focusing on insurance coverage, consumer protection laws, trade secret litigation and business torts.  Brian has been focused most recently on representing M&A transaction liability insurers in disputes arising under representations and warranties insurance policies, including managing, quantifying and resolving pre-dispute insurance claims for alleged losses arising out of M&A transactions.  Brian also represents leading insurance companies in arbitrations over coverage afforded by representations and warranties insurance policies. 

Brian also has significant experience defending accounting firms in professional liability actions arising out of tax-advantaged transactions.

EXPERIENCE

  • Represented an insurer in a class action involving a dispute over the number of UM/UIM premiums charged per household
  • Represented an insurer in a class action involving a dispute over the UM/UIM limits afforded owners of certain passenger vehicles and achieved a favourable resolution prior to certification proceedings
  • Represented an insurer in a UM/UIM coverage class action and obtained dismissal of the bad faith, breach of contract and consumer fraud act claims
  • Represented a supplement manufacturer in a consumer protection class action and obtained dismissal of the lawsuit 
  • Represented insurers in numerous representations and warranties insurance claims and arbitrations premised on allegations that sellers breached representations in acquisition agreements

Prior Experience

Prior to attending law school, Brian worked for a technology infrastructure consulting firm in New York City, providing project management services to major financial institutions.

While in law school, he tried the championship round in the American Trial Lawyers Association's annual, national trial competition in Miami, Florida.
