Mary Catherine focuses her practice on pharmaceutical and medical device litigation and other complex, multi-jurisdictional product liability and mass tort suits involving personal injury. She has entered her appearance in numerous out-of-state matters and has significant courtroom experience representing clients at all stages of litigation. She has experience advising, preparing, and defending clients in a variety of proceedings, including matters before State's Attorneys General, and has a great deal of hands-on experience working with current and former employees of major corporations to prepare them for deposition and trial testimony. In addition, Mary Catherine also has experience defending clients against tort claims involving environmental contamination.

EXPERIENCE

  • Successfully tried cases to verdict and successfully resolved suits against hospitals and individual health care providers involving allegations of wrongful death, personal injury, negligence, breach of contract and intentional tort.
  • Served as member of work-up counsel and trial team for bellwether case in multidistrict litigation involving claims against manufacturer of an anticoagulant medication, including initial case evaluation and selection, depositions of fact and expert witnesses, and preparations of witnesses for trial.
  • Served on trial team in multi-district proceedings involving claims against a manufacturer of Class III contraceptive device, including retention and development of expert witnesses, taking key fact witness depositions, and preparation of company and expert witnesses for deposition and trial.
  • Served as local counsel and member of trial team that secured multiple defense verdicts in federal court defending claims against a major pharmaceutical company related to its manufacture of hormone replacement therapy.
  • Served as work-up counsel for multidistrict litigation involving claims against pharmaceutical manufacturer of a statin medication proven to lower cholesterol, including coordination for bellwether selection process, taking key fact witness depositions, and assisting trial team with preparations related to the first two bellwether trials, which were dismissed by motion.
  • Served as pre-litigation counsel for in-state and out-of-state nursing home clients, including assistance with pre-suit investigations and evaluations.

Pro Bono

Mary Catherine has actively participated in a variety of pro bono initiatives throughout her career. She has assisted the Innocence Project in civil rights actions impacting prisoners on death row in Arkansas and has assisted with a judiciary investigation in conjunction with the Lawyers Committee on Civil Rights Under Law. She is actively participating in the National Veterans Legal Services Program discharge upgrade initiative, advocating for veterans seeking a military discharge upgrade or correction.
