Janice’s practice focuses on international arbitration and commercial litigation. She has handled disputes covering areas including financial instruments, licensing and distribution, insurance, international trade and sale of goods, shipping, energy and natural resources and general commercial disputes in the High Court of Hong Kong and arbitrations seated in jurisdictions including Hong Kong, London and Mainland China.

Janice has advised clients in numerous aspects of disputes including asset preservation, injunctions, applications for security as well as enforcement of arbitral awards and court judgments in various jurisdictions.

EXPERIENCE

  • Advising a leading container shipping company on time charter disputes where the subject vessel had been stranded for a prolonged period in Ukraine due to the outbreak of the war between Russia and Ukraine. Value of the claim exceeds USD40m.
  • Acting for a China-based company specialising in commodity trading in a sale of goods dispute arising out of a contract for sale and purchase of Russian coking coal, against the backdrop of extreme volatility in coal prices in 2021.
  • Acting for a Hong Kong-listed asset management and investment company in an arbitration at the HKIAC in relation to de-SPAC investment and exercise of put-option in a NASDAQ-listed company. Successfully obtained a favourable award as well as asset preservation orders from the Chinese Court in aid of arbitration proceedings in Hong Kong.
  • Acting for a Chinese distributor of medical appliances in an HKIAC arbitration brought by the American manufacturer of those appliances under a California law-governed exclusive distributorship agreement.
  • Acting for a subsidiary of a Hong Kong-listed company in the investment sector to recover under a loan agreement against securities company in an HKIAC arbitration. Successfully assisted the client in resisting an application by the respondent for joinder of the client’s parent company in the arbitration.
  • Advised and acted on behalf of a Hong Kong-listed company in the infrastructure construction business in an application to set aside a default judgment in the Hong Kong Court.
