Daniel Street advises clients on commercial disputes and regulatory matters, with a particular focus on banking and financial services.

His work covers contract disputes, fair dealing, ESG, greenwashing and climate-related disclosures. In particular, Daniel has helped clients with climate litigation risk, climate reporting, emissions target-setting and advertising claims.

Daniel has appeared as lead or junior counsel in all levels of the New Zealand court system.

EXPERIENCE

  • Acting for a leading Australasian bank in defending a breach of contract and misleading and deceptive conduct claim in relation to the sale of interest rate swaps. This case involved challenges to the bank’s standard contractual disclaimers and the scope of a bank’s duty of care when talking to customers about financial products. *
  • Acting for numerous banking and financial services companies and their directors in relation to Financial Markets Authority investigations.*
  • Advising several banks, managers of registered schemes and listed issuers on the application of New Zealand’s climate-related disclosures regime, including their obligations, potential liability and detailed analysis of the scope of reporting. *
  • Advising boards and management teams on ESG litigation risk, in particular greenwashing, regulatory oversight, shareholder activism, and NGO claims.*
  • Advising banks on their climate reporting, emissions target setting, sustainable finance frameworks, and advertising in relation to ESG claims. *
