An interview with Aldersgate Funding

Litigation Funding Podcast

Budgetary constraints are often cited as a major impediment by clients in deciding whether to pursue litigation or arbitration. Given current global economic uncertainty, expending capital on large-scale and costly disputes is something that businesses would prefer to avoid.

Litigation and arbitration funding provides claimants with the ability to pursue legitimate claims with the benefit of non-recourse lending, significantly reducing the financial downside risk (and most importantly, removing the cost of doing so from their balance sheet). It is a concept that has been around for many years, enabling prudent financial planning and risk management, and freeing up capital that can be better spent elsewhere.

In this podcast, DLA Piper partner Henry Quinlan interviews Jim Holding and Matthew Lo at Aldersgate Funding Limited, who shed some light on the advantages of litigation and arbitration funding; the types of claims eligible for funding; the process of funding a case; and the jurisdictional constraints on this type of financing. Litigation funding forms part of our Law& offering, aiming to deliver solutions beyond traditional legal services to help your business succeed.

About Aldersgate Funding

DLA Piper clients now have access to GBP150 million of committed capital for litigation or arbitration claims, including claims that vest in an insolvent estate. We have established an entirely independent company, Aldersgate Funding Limited (AFL) to facilitate this, backed by Litigation Capital Management Limited (LCM), which is listed on AIM, and seeks to offer excellent funding terms through the creation of a portfolio fund.

With funding secured from LCM and AFL, DLA Piper clients have access to non-recourse finance for 100% of the costs of bringing a claim, as well as the ability to source adverse cost cover and security for costs as necessary.
