EXPERIENCE

  • A digital platform providing intermediation services for accommodation and travel, in litigation matters arising from alleged breaches of consumer protection regulations, initiated by both private claimants and public authorities. These proceedings have resulted in favorable outcomes through settlements and court decisions dismissing the claims brought against the client
  • A leading construction company, in a high-profile arbitration concerning the interpretation and performance of construction contracts, including technical disputes related to project execution. His involvement included contributing to the procedural strategy and coordinating the client's defense
  • An international technology company dedicated to developing innovative digital solutions, in proceedings before both first instance and appellate courts concerning the application of consumer protection regulations. He contributed to the design of the defense strategy and the management of regulatory risk
  • Various clients in insolvency and liquidation proceedings, advising them in their capacity as creditors, interested third parties, or respondent companies. His work included developing debt recovery strategies, defending against liquidation petitions, and participating in key stages of insolvency proceedings
  • A European underwriting company, in the due diligence and negotiation process of a buyer-side warranty and indemnity insurance policy, aimed to cover buyer's liability in the acquisition of 100% of the shares of Sol de Septiembre SpA, owner of a photovoltaic power plant in operation
  • An individual in a fee collection lawsuit for brokerage services filed against her. The defense argued the absence of a breach of the relevant agreement, lack of legitimacy of the plaintiff, and unmet conditions for commission payment. After submitting strong evidence, the court dismissed the lawsuit
  • EPS Chile, a leading expanded polystyrene solutions company, on the successful recovery of invoices owed by Isotrón Chile SA for electrical consultancy services through the Chilean courts. Ultimately, Isotrón Chile SA sought a payment agreement, ensuring full recovery of the invoices in favor of the client
  • A private security company in a claim for damages for an alleged breach of security services. The arguments focused on the lack of standing and liability. Although the Court of Appeals overturned the initial ruling, DLA Piper was able to settle with the opposing party, resulting in the early termination of the proceedings
  • The local subsidiary of the world's largest cosmetics company in a successful case for a lawsuit and fine filed against it for alleged damage caused by a cosmetic product. We accredited the compliance with safety standards and the plaintiff's improper use of the product, achieving that in the Court of Appeals. We reduced the impact of the initial conviction, reaffirming the client's reputation and legal defense
  • A technology company executes consumer warranty claims, helps avoid litigation by settlement, and releases the client of any further liability
  • An international insurance company in drafting and negotiating the representations and warranties (R&W) insurance policy for a Chilean electricity production company to purchase 100% of the shares of another Chilean renewable energy generation company, which manages two operating wind farms in northern Chile
