Timothy Gilbert concentrates his practice on defending automotive, consumer goods, and manufacturing companies in complex commercial litigation, including class actions and multidistrict litigation. Tim advises automotive manufacturers and suppliers in high-stakes matters across state and federal courts in all phases of litigation – from jurisdictional and merits discovery to dispositive motions and trial strategy. He has a track record of success in challenging, long-running cases with limited precedent.

Tim is known for developing unique defenses in cases that present no easy answers. His skillful brief-writing and case management have yielded success across the spectrum of modern automotive legal challenges, from traditional product liability claims involving vehicle defects to emerging issues regarding cutting-edge technology. Tim has defended automotive manufacturers and suppliers against allegations of defective components, engine systems, safety features, and other critical vehicle systems that can cause costly class action settlements or adverse judgments. He regularly advises clients on managing business risks arising from active litigation, ensuring that external communications and regulatory submissions reflect litigation goals. In addition to his automotive experience, Tim defends consumer goods manufacturers in commercial disputes, where he has secured multiple dismissals in high-profile class action litigation.

Tim joined DLA Piper after working at another major law firm and clerking in the United States District Court for the Eastern District of Pennsylvania. He practiced journalism before his legal career, earning accolades for his coverage of Penn State news and sports.

EXPERIENCE

  • Defended an automotive parts company in multidistrict litigation brought by over 100 individual plaintiffs across 30 states alleging defective vehicle equipment. Obtained dismissal on behalf of the company from the litigation and retained to defend an additional automotive manufacturer named in the case
  • Defended several multinational automotive manufacturers in national consumer class actions, product liability matters, and jurisdictional disputes
  • Secured numerous dismissals for life and disability insurers against breach of contract and bad faith claims, including judgment on the pleadings in a complex case involving cost-of-living benefits

Pro Bono

Tim takes pride in his wide-ranging and successful pro bono practice. Tim regularly partners with nonprofit organizations in Philadelphia to promote civil rights and to support those who cannot afford representation.
