Jacob I. Chefitz represents clients in complex commercial disputes in federal and state courts around the country. He works with clients at every stage of a case, from pre-suit counseling through appeal, and he has represented companies across a broad range of sectors in high-stakes business litigation in both defensive and affirmative postures.

At the trial level, Jacob has served on teams in bench and jury trials across the country. Recently, he helped secure a successful defense verdict for a client in a federal jury trial in New York. He is also regularly called upon to brief dispositive and non-dispositive issues.

Jacob also maintains an active appellate practice. He has presented oral argument before the U.S. Court of Appeals for the Second Circuit as well as New York state appellate courts, and he has drafted merits and amicus briefs in state and federal appellate courts nationwide.

EXPERIENCE

  • Representing a global asset manager in affirmative and defensive litigations relating to the possession of a boutique hotel, and obtained the dismissal of a lawsuit brought against the client in New York state court by the hotel's operator
  • Successfully defended law firm at trial against claims of employment discrimination and retaliation
  • Representing an industrial gases company in federal and state court actions in Delaware involving claims arising from the development and operation of a renewable-fuels refinery. As part of this representation, Jacob helped obtain the complete dismissal of claims brought against the client in Delaware Chancery Court
  • Represented a leading insurance corporation in an an arbitration involving claims arising from a professional liability insurance policy
  • Represented a major pharmaceutical company asserting claims in federal court for tortious interference with contract and deceptive trade practices arising out of alleged misappropriation of patient assistance funds
  • Represented a major pharmaceutical company in federal litigation against networks of healthcare providers that defrauded company's free-drug program, and helped secure for the client a substantial recovery that included a $131 million default judgment
  • Represented a major medical devices company in a suit alleging breach of a merger agreement relating to a surgical robotics company
  • Represented a financial services company in federal and state court actions concerning residential mortgage-backed securities. As part of this representation, Jacob was a member of a trial team that secured for the client a $1.85 billion settlement mid-way through trial
  • Represented a payments technology company in a Delaware false claims act case alleging failure to remit escheatable unclaimed property to the state

Pro Bono

  • Represented mother in emergency docket proceedings and subsequent petition for certiorari before the U.S. Supreme Court in case arising under the Hague Convention on the Civil Aspects of Internal Child Abduction
  • Filed amicus briefs in the U.S. Supreme Court in Landor v. Louisiana Dep't of Corrections & Public Safety (No. 23-1197), Ciminelli v. United States (No. 21-1170), Percoco v. United States (No. 21-1158), and FBI v. Fazaga (No. 20-828)
  • Obtained reversal by the U.S. Court of Appeals for the Third Circuit of the dismissal of an incarcerated man's Eighth and Fourteenth Amendment claims arising out of his prolonged solitary confinement
  • Briefed and argued appeal in the U.S. Court of Appeals for the Second Circuit on behalf of a noncitizen seeking reopening of his removal proceedings, and received a 2021 Pro Bono Publico Award from the Legal Aid Society in recognition of this pro bono work
  • Argued multiple criminal appeals in the New York State Appellate Division, Second Department
