About

Magdalena Zabłocka-Foulkes has over fifteen years of experience in advising on the major infrastructure projects on local and international market, including those implemented under the public-private partnership (PPP). She worked on the first PPP project in Poland in the waste management sector in Poznan.

Magdalena has an in-depth, practical knowledge of the market of infrastructure projects, especially those implemented in the PPP formula, and practical knowledge of local government, which strengthens the team that runs one of the largest projects on the Polish market in the energy, transport, urban, road, maritime and water and sewage infrastructure sectors.

EXPERIENCE

  • Advising an international investment fund in an energy-efficiency PPP project in Poland, supporting the Client in the procurement phase, drafting and negotiating main subcontracts (2021)
  • Advising an international contractor in number of Waste to Energy projects including WtE Plant Project in Warsaw (yellow FIDIC), including negotiating EPC contracts with main nominated subcontractors (technological partner) (2018-2019)*
  • Advising an international consortium in the project re: design, construction and maintenance of the Waste to Energy incineration plant in Gdansk under DBO model (Astaldi Sp.A / TME / TIRU), including preparing main head-of terms of main subcontractors (2016-2018)*
  • Advising and coordinating legal, technical and financial advisory for the City of Poznan in the first Polish Waste to Energy PPP project under DBFM scheme, co-financed by the EU grant, including drafting and negotiating the PPP contract and a direct agreement (2010-2012)*
  • Advising the Solidarity Transport Hub (Centralny Port Komunikacyjny) on public procurement and contractual issues with respect to the selection of the main advisors for the STH Airport project (Master Planner, IPM and Strategic Advisor) (2019-2020)*
  • Advising the Icelandic Road Authority as a member of the International Procurement Group, in the project regarding the design, construction of the public road system for the rapid bus system for the City of Reykjavik (Borgalina) Project, Iceland. Drafting Project Advisor and Integrated Design Advisor contracts; advising KADECO on contractual aspects on the proceeding regarding selecting Masterplann for Keflavik Airport (2019-2020)*
  • Supporting the Ministry of Development Funds and Regional Policy / City of Zory in the social housing PPP project under the DBFMO scheme, including preparing draft PPP contract (2019-2020)*
  • Advising the City of Krakow in the first stage of the PPP project re: design, construction and maintenance of the new rail track (4.5 km) under the DBFM scheme (2018) *
  • Advising a number of private partners in PPP road projects (i.a., Budimex, FBSerwis) under DBFM scheme, including project in Wroclaw. Acting as a lead legal advisor of Hochtief PPP Solutions in number of social infrastructure projects under DBFM scheme (i.e. District Court in Nowy Sącz) (2014-2018)*
  • Advising the City of Warsaw in the first public works concession project in Warsaw regarding design, built and maintenance of 1560 bus shelters for Warsaw (2010-2013)*
