Justin Stacy is a litigation associate whose practice spans complex commercial litigation, consumer class actions, and regulatory risk management, with a focus on California’s Proposition 65, consumer protection laws, advertising and subscription practices, securities litigation, and product labeling compliance.

Justin counsels global brands, e-commerce leaders, and high-growth companies across the technology, consumer products, and food and beverage sectors. He represents clients in high-stakes matters and brings a dual lens of litigation experience and regulatory foresight to help clients mitigate risk while also achieving business goals.

Justin has helped leading online retailers and consumer brands defeat class actions and resolve mass arbitrations, navigate regulatory enforcement threats, and develop forward-looking compliance strategies to avoid litigation or regulatory action altogether. He has obtained complete and partial dismissals, enforced arbitration agreements, and secured favorable settlements in complex litigation in state and federal courts—including the Ninth Circuit. His recent work includes helping multinational consumer product companies respond to Proposition 65 notices involving novel chemical listings, representing e-commerce companies in matters involving subscription practices and auto-renewal laws, and counseling companies on nationwide marketing and labeling compliance.

Justin’s litigation practice is backed by deep experience managing fact development, expert strategy, and dispute resolution from pre-complaint through trial. He has also played a central role in internal investigations, product or marketing risk assessments, and client-facing strategy briefs designed to identify and address exposure and risks early—before it becomes a headline or enforcement action.

Representative Experience 
  • Defended a leading telehealth provider in a consumer class action in federal court concerning California’s autorenewal law and deceptive advertising statutes, including reaching a favorable settlement after significantly narrowing the claims through a successful motion to dismiss and negotiating complex injunctive relief obligations tied to user interface redesigns and disclosure updates
  • Defended a major consumer tax software company in a first-of-its-kind mass arbitration campaign, involving tens of thousands of individual arbitrations asserting state law false advertising and fraud claims, ultimately driving a favorable confidential global settlement following early and overwhelmingly favorable merits rulings by arbitrators
  • Defended an e-commerce retailer facing various tort, contract, and statutory claims brought by former contractors and franchisees, securing an order enforcing the arbitration agreement and class action waiver, including a significant Ninth Circuit win affirming the lower court in a published opinion addressing the scope of the FAA’s exemption for transportation workers, significantly limiting the scope of claims and establishing favorable precedent for subsequent related litigation
  • Defended an e-commerce retailer accused of defamation and negligence related to the termination of an independent contractor, defeating multiple amended complaints through successful demurrers and obtaining a complete dismissal with prejudice in California state court
  • Representing global beauty brands in multiple Proposition 65 matters, both pre-litigation and in active enforcement proceedings
  • Advise numerous technology and consumer product companies, including many industry leaders and household names, on advertising and labeling best practices to mitigate exposure from various state regulatory and consumer protection statutes, including state Automatic Renewal Laws and FTC regulations
  • Advise consumer product companies, including sellers of cosmetics and personal care products, food and beverages, supplements, and technology services, on compliance with California’s Proposition 65, state and federal labeling and packaging regulations, various safety laws, and general product liability risk associated with product lines including cosmetics, supplements, software, apparel, subscription services, and household goods
  • Defended e-commerce retailer in several related class actions filed in federal court involving claims of deceptive subscription enrollment practices, significantly narrowing claims through targeted motions to dismiss and managing complex, cutting edge document collection and expert analysis involving terabytes of consumer data critically relevant to liability in the underlying claims
  • Defended a leading lash and beauty brand in multiple complex intellectual property and false advertising cases, including wins such as obtaining a preliminary injunction, successfully asserting counterclaims that forced the plaintiff to drop a suit, and a $30+ million jury trial verdict in our client’s favor
  • Defended a public technology company in a federal securities class action under the Exchange Act, securing full dismissal with prejudice at the pleadings stage through successive prevailing motions to dismiss and after multiple amendments of the complaint in attempts to cure the defects
  • Represented several publicly listed companies, including a medical device company and a large food subscription retailer, in connection with FINRA investigations and securities litigation stemming from business combinations, including a multi-billion-dollar transaction, swiftly reaching resolution of all pending litigation and investigations without further action in each case
  • Conducted internal investigations for public and pre-IPO clients in connection with whistleblower claims, shareholder letters, and SEC inquiries, including allegations of accounting fraud, insider trading, and FCPA violations
