Construction & Energy – Arbitration and Litigation 

• Defended a leading international energy equipment manufacturing and services company in a €300 million+ ICC arbitration, seated in London, UK, arising from alleged defects and delays claimed by an EPC contractor on the largest combined cycle gas turbine power plant in Europe, located in Central Greece. Worked closely with the DLA Piper London office.
• Represented a global leader in the design and construction of large, complex projects in a €300 million+ ICC arbitration, seated inVienna, Austria, involving a motorway and tunnel infrastructure project in Central Europe. Worked closely with the DLA Piper Austria and Slovakia offices.
• Defended a joint venture of tier 1 contractors in a high-stakes Resolution Institute arbitration, seated in Sydney, Australia, against a subcontractor's EOT and variation claims on the Australian New South Wales Government's $12 billion AUD+ Sydney Metro Northwest project.*
• Represented a tier 1 contractor in an expediated Australian Centre for International Commercial Arbitration (ACICA) arbitration, seated in Sydney, Australia, related to defective works on the Australian New South Wales Government's $1 billion AUD hospital redevelopment project in Western Sydney.*
• Defended an Australian New South Wales government organisation in an Adjudicate Today adjudication dispute relating to a social housing development scheme in which a tier 1 contractor claimed in excess of $3 million AUD for escalation costs.*
• Acted for a developer in New South Wales Supreme Court proceedings against a subcontractor'sdefective construction of a privately owned mental health hospital in Sydney Australia, achieving settlement prior to final hearing. *
• Represented an American multinational food corporation in New South Wales Supreme Court proceedings against a tier 1 contractor over defects at a major refinery project.*
• Represented a subcontractor responsible for executing construction works on a vital component of a pumped-hydro battery megaproject, focusing on resolving outstanding EOT and variation claims.*
• Key involvement in evidence preparation and submission drafting for published New South Wales Supreme Court case law landmark decisions which confirmed that insolvent construction companies can still claim debt owed under construction contracts pursuant to the Security of Payment Act 1999 (NSW). This led to the recovery in excess of $1 million AUD. Published case law decisions include Piety Constructions v Megacrane Holdings Pty Ltd [2023] NSWSC 309 and Kennedy Civil Contracting (Administrators Appointed) v Richard Crookes Construction Pty Ltd [2023] NSWSC 99.*

Commerical – Arbitration & Litigation

• Represented a private jet company (duly registered in Malta) seeking the recovery in over $1 million USD in outstanding amounts due in commercial transactions relating to the lease of a private jet aircraft by a company duly registered in Switzerland. Worked closely with the DLA Piper Belgium office.
• Advised a large insolvent construction company in a dispute with financiers and creditors, including representation in the Federal Court of Australia and the drafting of a DOCA – a binding agreement between a company and its creditors to provide a better return to creditors than liquidation, issued under the Corporations Act 2001 (Aus). This assisted in the recovery of over $500,000 AUD.*
• Advised directors and shareholders of construction companies on restructuring options pre-insolvency, in light of COVID-19 supply chain disruptions, labour shortages and changes in work practices.*

Construction & Energy – Project Advisory

• Assisted in the drafting and preparation of a GC21 suite of contracts for a $300 million AUD+ stadium upgrade.*
• Represented a large health food manufacturing company across Australia and New Zealand in contract negotiations for an $60 million AUD+ upgraded manufacturing facility, including integrating an AS4910 contract with a leading Japanese automated material handling provider (for pallet-moving equipment supply and installation), with an AS4902 contract for the design and construction of supporting bridges.*
