Defended a joint venture of tier 1 contractors in a high-stakes Resolution Institute arbitration, seated in Sydney, Australia, against a subcontractor's EOT and variation claims on the Australian New South Wales Government's $12 billion AUD+ Sydney Metro Northwest project.*

Key involvement in evidence preparation and submission drafting for published New South Wales Supreme Court case law landmark decisions which confirmed that insolvent construction companies can still claim debt owed under construction contracts pursuant to the Security of Payment Act 1999 (NSW). This led to the recovery in excess of $1 million AUD. Published case law decisions include Piety Constructions v Megacrane Holdings Pty Ltd [2023] NSWSC 309 and Kennedy Civil Contracting (Administrators Appointed) v Richard Crookes Construction Pty Ltd [2023] NSWSC 99.*
Commerical – Arbitration & Litigation
Represented a private jet company (duly registered in Malta) seeking the recovery in over $1 million USD in outstanding amounts due in commercial transactions relating to the lease of a private jet aircraft by a company duly registered in Switzerland. Worked closely with the DLA Piper Belgium office.
Advised a large insolvent construction company in a dispute with financiers and creditors, including representation in the Federal Court of Australia and the drafting of a DOCA – a binding agreement between a company and its creditors to provide a better return to creditors than liquidation, issued under the Corporations Act 2001 (Aus). This assisted in the recovery of over $500,000 AUD.*
Advised directors and shareholders of construction companies on restructuring options pre-insolvency, in light of COVID-19 supply chain disruptions, labour shortages and changes in work practices.*
