Zachary Loney focuses his practice on patent litigation and intellectual property related matters. Zachary represents clients before District courts, the International Trade Commission, and in inter partes review proceedings before the USPTO's Patent and Trial Appeal Board.

Zachary has significant experience across a wide range of hardware and software technologies including mobile payment solutions, contactless interfaces, biometric solutions, distributed networks and cloud computing, video coding/decoding, and smart phone components including digital cameras, touch screen assemblies, actuators, LED’s, and software.

EXPERIENCE

  • Represented a major global consumer electronics company in the Western District of Texas concerning six patents involving contactless payment systems and NFC technology. One patent was found invalid via inter partes review and the plaintiff voluntarily dismissed its allegations regarding two more patents. The case subsequently settled on terms extremely favorable to our client.
  • Neonode Smartphone LLC v. Samsung Electronics Co. et al. – Western District of Texas. Represented Samsung Electronics in a district court action brought by Neonode Smartphone asserting 2 patents involving touch-based user interfaces. One patent was ruled invalid via inter partes review. Obtained a ruling that the remaining patent was invalid as indefinite under § 112.
  • Represented a major global consumer electronics company in the Western District of Texas regarding one patent involving contactless payment systems and NFC technology. Obtained grant of summary judgment of noninfringement just prior to trial.
  • Election Systems & Software, LLC v. Smartmatic USA Corp. – District of Delaware. Represented Smartmatic in a district court action brought by ES&S asserting 2 patents involving voting machines. During the course of litigation, ES&S voluntarily dismissed all infringement claims for one patent. Obtained judgement on the pleadings that the remaining patent was invalid under § 101.

Pro Bono

Working with International Association of Women Judges (IAWJ) to assist Afghan women judges who were forced to flee Afghanistan with their immigration and asylum applications.
