About

Ana Cristina has wide experience in labor and employment consultancy and litigation. She advises on litigation prevention and contingency reduction; routine employment matters, as well as layoffs, revision of indemnities and severance packages. She analyses and drafts contracts and advises companies involved in corporate reorganization and restructuring on labor matters. She has expertise in individual and collective labor claims; and collective bargaining agreements.

She is additionally experienced in the analysis and drafting of contracts.

EXPERIENCE

  • Advises clients in labor and employment matters as well as litigation
  • Advises clients in the negotiations for the hiring and firing of High Level Executives, including drafting and negotiation of related agreements
  • Advises clients in the investigation and termination of employment contracts for cause (misconduct, sexual and moral harassment)
  • Prepares and ministers training sessions about compliance, internal policies, harassments and its aspects and nuances
  • Drafts handbooks and trains HR teams
  • Reviews termination packages and severance amounts
  • Drafts labor and employments related agreements, including Profit-Sharing Programs
  • Conducts negotiations with labor Unions
  • Advises clients in identifying labor issues and drafting action plans to reduce or eliminate labor contingencies
  • Defends clients in class action suits filed by Prosecutor Labor Office and negotiates settlements and TACs
  • Acts in defense of clients at administrative proceedings filed as a result of infraction notices (lack of working hours control, hiring of apprentices, hiring of disabled individuals, among other matters)
