New trademark revocation and invalidity proceedings in Italy

In Italy, trademark cancellation actions (both revocation and invalidity) have, until now, been decided exclusively by specialized judges in civil court proceedings. As of 29 December 2022, actions can be filed before the Italian Patent and Trademark Office, following the implementation of amendments to the Italian Industrial Property Code. This new alternative route allows interested parties to choose between civil or administrative proceedings, decreasing the workload of the specialized courts and reducing the length and cost of actions.

In the first part of our webinar we will outline the status quo of trademark revocation and invalidity proceedings before the Italian civil courts. In the second part we will focus on the new trademark invalidity and revocation proceedings before the Italian Patent and Trademark Office and the Boards of Appeal. A Q&A session will follow.
