Philip Apfel advises on construction and engineering disputes and has experience across various dispute resolution methods including High Court litigation, adjudication, international arbitration, and mediation. Philip regularly advises employers, contractors, subcontractors and other construction professionals on domestic and international construction projects on a broad range of often complex issues including delay, defects, design liability, payment and termination.

Philip's clients have included companies in a range of sectors including energy & natural resources (renewables, oil and gas), infrastructure, hotels, healthcare, and residential property.

EXPERIENCE

  • Advising a JV of Korean and Japanese contractors in an ICC arbitration against the subcontractor at a refinery in Saudi Arabia, involving delay and disruption, termination, and a disputed call on performance security.
  • Advising a US contractor in connection with an ICC arbitration (claim value EUR 300m) relating to a combined cycle power plant in Southern Europe.
  • Advising a Belgian contractor in connection with an ICC arbitration (claim value EUR 60m) relating to the construction of a large port project in Morocco.
  • Advising a conglomerate in connection with an ICC arbitration (claim value EUR 60m) with a JV partner relating to the construction works at a thermal power plant in Turkey.
  • Advising one of the UK's leading renewable energy providers in relation to a set of defects at a nuclear power plant.
  • Advising a large, global engineering consultancy in respect of defect claims across various projects including flood defence and bridge infrastructure.
