Philip Apfel advises on construction and engineering disputes and has experience across various dispute resolution methods including High Court litigation, adjudication, international arbitration, and mediation. Philip regularly advises employers, contractors, subcontractors and other construction professionals on domestic and international construction projects on a broad range of often complex issues including delay, defects, design liability, payment and termination.

Philip's clients have included companies in a range of sectors including energy & natural resources (renewables, oil and gas), infrastructure, hotels, healthcare, and residential property.

Philip is a native speaker of German and Mandarin.

EXPERIENCE

  • Advising Employer clients on various wind farm projects in Scandinavia, including in relation to delay, liquidated damages, supply chain issues and defects.*
  • Advising one of the UK's leading renewable energy providers in relation to a set of defects at a nuclear power plant.*
  • Advising a JV of Korean and Japanese contractors in an ICC arbitration against its subcontractor at a refinery in Saudi Arabia, relating to delay and disruption, termination, and a disputed call on performance security.*
  • Advising a large, global engineering consultancy in respect of defect claims across various projects including flood defence and bridge infrastructure.*
  • Advising several major UK developer clients in relation to building safety matters across tens of their developments, and achieving favourable settlement following High Court litigation and mediation.*
