Pavlo Bogachenko represents clients in cross-border litigation, investment disputes and international arbitrations under various arbitration rules, including LCIA, LMAA, ICC, ICSID, and UNCITRAL. He also advises clients on regulatory, sanctions, and internal investigation issues.

Pavlo handles contentious matters for international clients across sectors such as aviation and aerospace, energy and natural resources, insurance and financial markets, infrastructure, life sciences, professional services, and telecommunications.

He is a member of DLA Piper's International Ukraine Group. As a Ukrainian attorney, Pavlo has represented clients before courts of all levels and specializations, including the Supreme Court. Pavlo advises clients on contentious and compensation-related issues arising from the impacts of the Russian invasion of Ukraine.

Pavlo is involved in DLA Piper's pro bono projects in Ireland and internationally, including those focused on Ukraine's reconstruction and EU accession.

EXPERIENCE

  • Advising a provider of insurance and reinsurance in relation to claims brought by Irish aviation lessors following Russia’s invasion of Ukraine. Litigation has been instigated by policyholders in Ireland, the UK and the US. 
  • Representing Ukraine’s leading agricultural group in an international investment arbitration claiming compensation for USD1.2bn in losses caused by the Russian invasion of Ukraine, including advising on third party funding and enforcement proceedings in relevant EU jurisdictions.
  • Advised relatives of victims of Malaysian Airlines flight MH17, shot down over eastern Ukraine in July 2014, on Ukrainian law matters related to damages and recovery claims, in a case considered by the Dutch Criminal Court.
  • Advised claimants in an ICSID dispute brought under the Azerbaijan-Georgia BIT.
  • Represented one of the world’s largest pharmaceutical companies in contentious and regulatory matters relating to the supply of an innovative healthcare product in several European jurisdictions.
  • Advised a Ukrainian energy company on a potential arbitration under the Ukraine-Russia BIT and international litigation strategy following the destruction of the client’s assets caused by the Russian invasion of Ukraine.
  • Advised an international underwriting business regarding multi-million aviation insurance claims arising from alleged aircraft fleet losses due to the war in Ukraine.*
  • Represented a pool of international investors acting as claimants in a multi-billion BIT claim brought against an Eastern European state regarding expropriation of client's investments.*
  • Advised a global consulting company in a series of complex, multi-faceted and cross-border matters involving multi-billion dollar claims by the executive branches of government and Ukrainian law enforcement authorities.*
  • Represented a leading European energy company in a multi-million enforcement proceedings of the Arbitration Institute of the Stockholm Chamber of Commerce Award.*
  • Represented a high-profile insurance company and its insured automotive client in a product liability case before Ukrainian courts.*
  • Represented clients before the London Maritime Arbitrators Association in a dispute concerning the transfer of shares in shipping companies.*

Pro Bono

Pavlo coordinates pro bono projects of DLA Piper's Dublin office and participates in various international pro bono matters of the firm, including: 

  • Coordinating DLA Piper's annual Know Your Rights programme in Ireland.
  • Organizing and speaking at Ukrainian Business Bootcamp in Ireland to support displaced Ukrainian startups.
  • Contributing to the World Bank Group's Women, Business and the Law 2024 report.
  • Contributing to the Rule 39 Pro Bono Initiative, led by the Italian Coalition for Civil Liberties and Rights in collaboration with international law firms, a project under which lawyers and experts provide pro bono assistance to vulnerable foreigners, and to the NGOs working with them, in submitting cases to the European Court of Human Rights.
  • Co-organizing Seminar series to support displaced Ukrainians in collaboration with the Irish Legal and NGO community. The project won the PILnet Local Impact Award 2024.
  • Providing training on pro bono and public interest law for law students of Uzhorod National University Faculty of Law, a law school in Western Ukraine, to help in setting up a legal clinic to assist Ukrainian small businesses impacted by war.
  • Representing a minor displaced author on the protection of intellectual property rights under publishing contracts.
  • Advised a leading European renewable energy producer on compensation of damages arising out of the Russian invasion of Ukraine and implementation of mechanisms for documentation of war-related damages.*
  • Managed full-scale compliance and anti-corruption risks assessment for one of the leading universities in Ukraine.*

Prior to joining DLA Piper in Ireland, Pavlo Bogachenko worked for a leading regional law firm (2012-2018) and international law firms in Ukraine (2018-2023), including DLA Piper Ukraine.

Pavlo also participated in the Exchange Programme for Young Lawyers organised by the Bar Council of England and Wales (London, 2016) and interned at the Special Litigation Division of the Cook County State's Attorney's Office (Chicago, 2020).
