For more than 25 years, Peter Borg has been providing legal solutions for defence, infrastructure, energy and resources projects. Peter understands projects, from inception to completion, having worked on many high-profile projects, including submarines, LNG plants, mines, airports and railways.

Peter brings a versatile skill set gained from working in-house for many multi-national corporations.

Peter appreciates commercial drivers and the need for sensible risk allocation. He has nipped problems in the bud by providing practical and commercial legal advice throughout the project delivery phase to address issues before they turned into costly crises.

Peter’s voice of reason style and ability to concentrate on issues that matter, maintains commercial relationships and avoids satellite arguments.

Prior to joining the legal profession, Peter was a project engineer. Peter's engineering experience is particularly useful in building rapport with technical personnel and understanding technically complex issues.

EXPERIENCE

  • Acted for a major international defence contractor in relation to the termination of its contract for the supply of twelve conventionally powered submarines. Peter worked hand in hand with the contractor, advising in relation to the contractual termination provisions and then in negotiating the eventual settlement, which resolved the matter on very favourable terms to the contractor. Peter then took on the role of General Counsel & Company Secretary of the contractor’s Australian subsidiary and wound down the subsidiary into dormancy.
  • Acted for the multi-national consortium responsible for construction of the Ichthys Onshore LNG Facilities near Darwin, in relation to technically complex, multi-billion dollar claims against the owner/operator in ICC arbitration proceedings.
  • Acted for a US based oil and gas company in relation to all aspects of its Australian operations. Responsible for JV relationships, operator & non-operator agreements, farm-in & farm-out arrangements and disputes (including a multi-billion dollar litigation against APLNG).
  • Acted for a major international contractor as the lead lawyer responsible for negotiating and drafting the entire suite of contracts, from head EPC contracts to multiple subcontract packages, for a multi-billion dollar coal mine, rail and port project in Australia.
  • Acted for a Government owned corporation in relation to providing 'whole of life' project advice regarding the construction of multi-billion dollar harbour works for the Curtis Island LNG Project. Advised on multi-million dollar claims by the civil works contractor and the dredging contractor; resolved disputes through negotiation and mediation; and dealt with the federal Government investigation into environmental issues.
  • Acted for a US based international contractor in relation to claims advice in relation to its construction of the multi-billion dollar LNG facilities for all three of the Gladstone LNG Projects. Advised the contractor on its rights and obligations up the line against project owners as well as down the line against subcontractors.
