Bryan Chan
Senior AssociateBryan has substantial experience in commercial litigation and arbitration. He has advised and acted for banks, funds, joint ventures and companies in various industries including real estate, pharmaceutical, sports, TMT, hotel, property management and shipping.
Bryan has a particular focus on handling shareholders disputes, breach of directors’ duties, contractual disputes, insolvency and winding-up, breach of trust, fraud, property management and defamation.
Bryan regularly advises and represents clients in proceedings at various levels of the Hong Kong courts, as well as arbitrations in the HKIAC, CIETAC, LCIA and SIAC.
Bryan is a solicitor admitted in the High Court of the Hong Kong SAR. He is also qualified to practice in the Greater Bay Area. Bryan is an accredited mediator of the Hong Kong Mediation Accreditation Association Limited and an Associate member of the Chartered Institute of Arbitration (East Asia Branch).
EXPERIENCE
- Advised and acted for the majority shareholder of a leading glove manufacturer and successfully opposed the minority shareholder’s summary judgment application and winding-up petition based on unfair prejudicial conduct and just and equitable grounds.
- Advised and acted for a global leader in commercial real estate services and investments in pursuing claims for unfair prejudice and just and equitable winding up of a BVI joint venture company with investments in Mainland China.
- Advised and acted for the founding shareholders who are also directors of one of the most popular hospitality groups in Hong Kong in defending claims for breach of fiduciary and directors’ duties and trademark passing off.
- Acted for offshore companies whose shareholder ultimately owns the 2 largest wind farms in Thailand and successfully obtained injunctions (with Chabra extension) and receivership orders in aid of Singapore arbitral proceedings.
- Advised a renowned American toy, clothing and baby product retailer on jurisdictional issues and on the commencement of anti-suit injunctions in aid of Chapter 11 bankruptcy proceedings in the United States.
- Advised and acted for a leading trust and corporate services provider and successfully resisted claims of fraud and breach of trust involving residential and commercial estate development in the PRC.
- Advised and acted for an international equities financer in arbitrations in the HKIAC to resist claims of fraud and breach of loan and share pledge agreements.
- Advised and acted for the world’s leading Internet-related service and product provider in successfully defending a defamation claim by a well-known local newspaper.
- Advised and acted for an international equities financer and successfully procured the removal of defamatory posts published on Hong Kong and PRC internet forums.
- Advised and acted for one of the largest property managers in Hong Kong in the enforcement of DMCs and the Building Management Ordinance in over 60 residential and commercial developments.
