Louise is a disputes lawyer, with over 12 years’ experience representing parties in technical and often large-scale litigation and arbitration in the infrastructure and construction, energy and natural resources, and insurance industries.

Louise is experienced in international arbitration in various forums, domestic arbitration, mediation, commercial negotiation and litigation before Australian Federal and State courts.

EXPERIENCE

Construction

  • Advising and assisting an overseas government body in defending a contractor's USD7.6 million Disputes Board claim pursued under a FIDIC Contract for alleged contractual breaches, prolongation costs and delays on an inter-island shipping construction and rehabilitation project.
  • Defending an EPC contractor against ICC arbitral proceedings for its application of an inadequately performing protective coating system, involving expert analysis and technical advice on the cause and rectification of performance issues.
  • Defending an adjudicated payment claim against a power station owner and operator, and pursuing a multitude of significant adjudication payment claims on behalf of an EPC contractor, under the Northern Territory and Western Australian adjudication regimes, respectively.
  • Pursuing a USD13 million claim on behalf of an overseas government body for loss arising from a UK based engineer's defective design of shipping infrastructure project. 

Construction and insurance

  • Defending a USD55 million professional indemnity claim pursued under Swiss law against engineers for alleged design defects, inadequate material quantity estimates and delays on a copper processing plant in the Republic of Kazakhstan.
  • Acting for commercial architects in a copyright claim for alleged substantial reproduction of a predecessor architect’s marina-based facility designs before the Federal Circuit Court of Australia.
  • Defending a fire engineers’ performance solution assessment under the Building Code of Australia, including the specification of cladding, against a USD4 million rectification claim brought by residential apartment complex owners and strata corporation in the Victorian Civil and Administrative Tribunal.

Energy and natural resources

  • Acting for a Mozambican company in defending arbitral proceedings brought by a consultant before the ICC and seated in Geneva, and initiating a USD18.7 million counterclaim for inadequate management, consulting and exploration services rendered for a Mozambican coal mine.
  • Advising a tenement holder on the defence of a misleading and deceptive conduct claim pursued by a mining rights holder for the allegedly inadequate disclosure of open pit geotechnical data.
  • Acting in a boundary dispute before the Warden, Supreme Court of Western Australia and Court of Appeal between Western Australian tenement holders determinable by the construction of a Crown grant.
