Matthew specialises in dispute resolution across complex construction, engineering and infrastructure projects. He provides clients with contractual, practical, operational and risk management advice.

Matthew represents employers, contractors, SPVs and sub-contractors across a range of high value projects in the infrastructure and construction sectors both in the UK and internationally.

His experience includes litigation, international arbitration and ADR (including adjudication). Matthew also provides proactive, pragmatic and commercially focussed advise on dispute avoidance on live projects.

EXPERIENCE

  • Acting for a major UK developer to defend two high value defects claims in the High Court in respect of residential properties which gave rise to complex legal issues concerning the alleged breach of the Defective Premises Act 1972 and property ownership.
  • Acting for a Higher Education provider in relation to fire-stopping defects in student accommodation halls of residence which has involved commencing three High Court claims against various building contractors (for claims in contract, tort and breach of statutory duty).
  • Advising a leading infrastructure fund in respect of defects identified in a school portfolio and a social housing project (both in a PFI context).
  • Advising an international energy supplier in respect of defects arising on a windfarm project in multiple jurisdictions and advice concerning the termination of relevant contracts.
  • Acting for a UK developer to defend an adjudication brought against it on a project concerning purpose-built student accommodation and defects identified in its external cladding systems.
  • Acting for a global energy provider in an international arbitration in respect of a tortious claim brought against it and other group companies in respect of defects identified in a power plant.
  • Advising a leading infrastructure fund in respect of contentious operational advice on a hospital project including the settlement of various defects claims.
  • Advising a major construction contractor in relation to its portfolio of properties and disputes concerning alleged fire stopping defects and related issues. This includes advising the client on recovery from sub-contractors/passing on liabilities.
  • Advising a local authority in relation to the termination of an NEC3 Term Service Contract and related advice concerning an insolvent contractor.
  • Acting for a UK developer in a high value ‘smash and grab’ adjudication and issues concerning the final account in respect of luxury residential apartments in London.
  • Advising a FTSE 100 company in relation to the recovery of monies under a performance bond and advice concerning the administration of a principal contractor.
  • Advising a leading renewable energy biomass fuel supplier in relation to a dispute arising out of a long-term and exclusive Fuel Supply Agreement for a biomass power plant in Northern Ireland.
  • Acting for a UK rail company as main contractor in relation to claims for delay arising out of a major refurbishment of a train maintenance depot.
  • Seconded to a major international energy contractor as in-house legal advisor, advising across a range of disputes in the UK.
  • Acting for a global equipment manufacturing business in a SIAC arbitration defending a USD 17 million professional negligence claim over alleged defects in a gas turbine and a related contribution claim. Advised on a range of legal issues and participated in and attended the trial which was held in Singapore.
