Nicole Kozlowski focuses her practice on complex commercial litigation dealing with real property, construction, and complex contract disputes. She has represented national and international companies in connection with cases under the rules of the American Arbitration Association (AAA). Nicole's practice involves representation of corporations operating in the healthcare, financial services, and energy sectors in arbitrations and court proceedings. Nicole's practice also includes representing companies in complex commercial litigation matters throughout the country from pre-litigation demands through appeal.

EXPERIENCE

Nicole has handled and been a member of teams representing:

  • A Fortune 500 company in an AAA arbitration arising out of $140 million dispute related to the construction of a corporate headquarters, which included defending owner against delay claims and changes in scope of work
  • The American subsidiary of an Italian cement manufacturer in a multi-week AAA arbitration relating to the construction of a new cement plant (half-billion dollar project value) along-side an existing and operating plant.  Successfully defended against the contractor’s claim for in excess of $50 million in additional costs relating to delays and alleged scope changes
  • A commercial entity in an AAA commercial arbitration defending against a $100 million claim, relating to the construction and operation of a scrap metal processing plant
  • A commercial entity in a dispute in state court against the design-builder over the standard of care and workmanship used to design and build a structure in New Mexico
  • A Fortune 500 company in Texas state court arising out of a dispute between the owner, general contract, and architect regarding the construction of a corporate headquarters
  • Privately owned entities in Maryland state court in actions related to real estate and eminent domain
