Kent Love focuses his practice on complex business and commercial disputes.  Kent represents clients in a wide range of industries, including energy, technology, real estate, construction, retail, media, healthcare, finance, hospitality, transportation, entertainment, and insurance.

Kent has extensive experience in litigation resulting from mergers and acquisitions, including post-closing earnout and purchase price adjustment disputes.  Kent’s broad experience also covers cases involving breach of contract, trade secrets, fiduciary duty, noncompetition agreements, conversion, deceptive trade practices, shareholder disputes, tortious interference, landlord-tenant disputes, conspiracy, and fraud. Kent also has significant experience in bankruptcy matters, including litigation involving fraudulent and preferential transfers.

Kent works closely with each client to tailor a strategy that will meet their particular goals.  He has achieved favorable results in state court, federal court, bankruptcy court, in arbitrations, and on appeal.

EXPERIENCE

Business and Commercial Litigation 
  • Secured final judgment for one of the nation's largest privately held companies specializing in foodservice distribution dismissing all claims alleged against it and obtaining award of attorneys' fees in case alleging millions in damages

  • Obtained walk-away settlement for multinational supermarket chain in case involving allegations of fraud and over $4.5 million in damages

  • Secured final summary judgment dismissing all six claims alleged against private non-profit corporation

  • Secured $2.8 million judgment for client in case involving breach of promissory note and breach of guaranty

  • Secured temporary restraining order and temporary injunction in case involving breach of non-compete and non-solicitation agreement, breach of fiduciary duty, and misappropriation of trade secrets, leading to favorable settlement for national mortgage lender

  • Secured temporary restraining order and preliminary injunction in case involving breach of non-compete and non-solicitation agreement and misappropriation of trade secrets, leading to settlement for large signage company

  • Represented restaurant chain in several landlord-tenant disputes throughout Texas

  • Obtained favorable settlement for former CEO of international education company in case alleging wrongful termination and defamation

  • Represented restaurant owner in complex construction defect case against general contractor and several subcontractors

Bankruptcy
  • Represented trustee as lead counsel in ten adversary proceedings seeking the avoidance and recovery of fraudulent and preferential transfers
  • Successfully represented former officers and directors of large nonprofit think tank who were sued for over $15 million for breach of fiduciary duty, settling case for nuisance value following removal of case from state court to bankruptcy court
  • Successfully represented Texas bank on appeal from lower court's decision regarding amount of bank’s claim against borrower
  • Successfully represented multiple clients in defense of lawsuits seeking recovery of preferential transfers, obtaining full dismissals or settlements in every case
  • Obtained settlement for client after defeating application for temporary restraining order in fraudulent transfer case
