EXPERIENCE

  • Acting for ASX100 energy company in the Supreme Court of Western Australia in relation to AUD86.5m indemnity claim made by a British multinational oil and gas company under a sale and purchase agreement, in connection with a government-imposed offshore petroleum decommissioning and rehabilitation levy.
  • Advising ASX100 energy company regarding the risk of climate litigation associated with the proposed acquisition of certain mature assets and a related organisational restructure.
  • Acting for a Switzerland-based manufacturer and distributor of aluminium composite panels in a class action commenced in the Federal Court of Australia.
  • Acting for privately-owned energy company in relation to force majeure claims made pursuant to an offtake agreement (coal) in the Supreme Court of Western Australia.
  • Acting for financiers in relation to the enforcement of their security over a significant property development and an associated AUD600m damages claim against the financiers in the Supreme Court of Western Australia, and on appeal in the Court of Appeal of Western Australia.
  • Advising the administrators of a major Australian engineering and construction company in relation to the trade-on and sale of certain corporate entities to an Italian industrial group (the final acquisition perimeter comprising more than AUD6bn of projects in backlog), including in proceedings in the Federal Court of Australia successfully obtaining novel limitation of liability orders for the administrators during the trade-on period.
