Mikołaj Strojnowski specialises in conducting legal disputes arising from business activity, in particular disputes related to the performance of various types of contracts. For over fifteen years he has been representing clients before common courts, the Supreme Court, and before national and international arbitration tribunals.

Mikołaj has represented clients in corporate disputes concerning various issues, such as post-transaction settlements, the validity of corporate resolutions, and the liability of the members of companies' governing bodies. He has handled a number of cross-border disputes, including cases connected with interim measures and the enforcement of the judgements of foreign courts and arbitration authorities.

He has extensive experience in infrastructure projects, including those based on public tenders, public-private partnerships and FIDIC contracts. He has represented many clients from the energy sector, in particular in proceedings relating to appeals against decisions of the President of the Energy Regulatory Office. He also advises entities from the defence sector in the course of tenders organised by the Ministry of National Defence and handles court disputes arising therefrom.

Mikołaj also provides various types of out-of-court assistance to clients, e.g. preparing strategies for crisis situations, drafting contracts, and representing clients in negotiations.

EXPERIENCE

  • Representing a Polish charter airline and its shareholders in court disputes with a former shareholder concerning the ownership of shares in the context of the company's IPO.
  • Advising and representing a global, Spain-based, renewable energy group in a number of court disputes with previous shareholders of its subsidiary with respect to a sale of rights to wind farm projects, legal titles to real estate, and the establishment of transmission easements.
  • Representing companies from the biggest Polish energy group in a number of court disputes with minority shareholders concerning the validity of resolutions regulating the division of profit.
  • Representing a company from the biggest Polish energy group in two court proceedings aimed at questioning the decisions of the President of the Energy Regulatory Office (URE) on state aid in the form of the reimbursement of so-called stranded costs connected with the early termination of long-term contracts for the sale of electricity.
  • Advising and representing a Belgian provider of environmental services and solutions in an arbitration dispute with its contractor concerning the development of a sludge drying plant in Poznań and also in subsequent proceedings before Polish common courts aimed at enforcing the award. The arbitral proceedings were conducted in English before the ICC International Court of Arbitration.
  • Representing a company from a leading Austrian construction group in court disputes with an employer and subcontractors concerning a project to convert a power generation unit to a biomass burning unit at the Siekierki Cogeneration Plant in Warsaw.
  • Advising and representing an Israeli provider of security solutions in a contractual dispute related to the provision of site security infrastructure for the biggest airport in Poland. The proceedings were conducted before the Arbitration Court at the Polish Chamber of Commerce in Warsaw and subsequently before a common court.
  • Representing a Danish producer of defence, aerospace and security solutions in a court dispute with the Polish State Treasury - Minister of National Defence regarding the supply of self-protection systems for Mi-17 and Mi-24 military helicopters.
  • Representing a leading Polish company from the outdoor advertising sector in a dispute with local authorities concerning the performance of a concession agreement for the construction and exploitation of city bus shelters. The project was the largest PPP contract of this type implemented in Poland to date. The proceedings were conducted before the Arbitration Court at the Polish Chamber of Commerce in Warsaw.
