Matthew Tam is dual qualified and practising in Hong Kong as well as England and Wales.

Matthew has a broad civil practice canvassing commercial court litigation, arbitration and regulatory matters, with particular emphasis on loan and security enforcement, civil fraud, insolvency (including winding-up and bankruptcy), receivership, international contractual disputes, cross-border disputes, tort and regulatory matters. He has acted for various listed companies, financial institutions, high-net-worth individuals and professional clients before all court levels in Hong Kong, arbitral tribunals and disciplinary tribunals.

Matthew has experience working with lawyers from various other legal jurisdictions, including Mainland China, Macao, Taiwan, the BVI, the Cayman Islands, Bermuda, England and Wales, Singapore, Indonesia, Malaysia, Germany, Australia, Canada and Luxembourg.

EXPERIENCE

  • Acting for an ultra high-net-worth individual in a large-scale multi-jurisdictional dispute canvassing Hong Kong, the BVI, Taiwan, Luxembourg and Samoa to enforce securities over a defaulted loan of over USD200 million. Secured a bankruptcy order against the debtor in contested Hong Kong proceedings as well as injunction and receivership orders in the BVI.

  • Acting for the liquidators of a former leading taxi insurer in Hong Kong in relation to the investigation and recovery of sums misappropriated from the company exceeding USD154 million, including conducting proceedings for civil fraud claim, civil appeal, winding-up and bankruptcy.

  • Acting for the receivers appointed pursuant to the provisions of security documents in a multi-jurisdiction enforcement matter and receivership sale canvassing Hong Kong, the BVI and Europe, involving a defaulted loan in the sum of over USD300 million.

  • Acting for the trustees-in-bankruptcy of a high-net-worth individual and founder of a Hong Kong-listed conglomerate in relation to cross-border asset tracing, recovery and preservation proceedings across multiple jurisdiction including Hong Kong, the BVI, Singapore, England and Wale, Germany and Australia, with debt claims exceeding HKD130 billion in aggregate.

  • Acting for an established Hong Kong financial institution in winding up the sole corporate shareholder of a Hong Kong insurance company in respect of indebtedness under bond-linked notes amounting over USD200 million and breach of settlement deed. Secured winding-up order against debtor in contested proceedings.

  • Acting for a prominent medical and healthcare group listed in Hong Kong in pursuing a post-acquisition claim exceeding HKD400 million involving complex accounting issues and breach of profit guarantee. 

  • Acted for a prominent medical and healthcare group listed in Hong Kong in securing a mandatory injunction order compelling cooperation from incumbent management of subsidiaries.

  • Acted for a Hong Kong company in a multi-contract dispute involving a carbon offset project in Indonesia. Prosecuted and defended multiple concurrent HKIAC arbitrations for client. Secured a resolution to the dispute for client.

  • Acted for a Hong Kong listed company in successfully resisting a winding up petition brought by noteholders and pursuing a comprehensive offshore debt restructuring scheme. Secured the court's validation order allowing the conversion of equity and placing of shares by client amidst ongoing winding-up proceedings.

  • Acted for a Singaporean investment vehicle of a global asset management firm as supporting creditor in obtaining winding-up order against a Hong Kong-listed Mainland Chinese real estate developer in contested winding-up proceedings.

  • Acted for a Hong Kong Certified Public Accountant and his audit firm in successfully defending HKICPA disciplinary proceedings. Secured the withdrawal of all disciplinary complaints against clients and a disciplinary committee order for HKICPA to pay contribution to clients' legal costs.*

  • Acted for a high net worth individual of a prominent Hong Kong family in an inheritance dispute litigation involving preparation of a 60-day long trial. A settlement was reached between client and other parties amidst trial.*

  • Acted for a renowned China-state-owned financial institution in Hong Kong in a HKD18.5 million margin facility and guarantee enforcement claim. Secured continual conduct of client's civil claim by resisting an appeal from the debtors against a court order dispensing with re-service of the writ.*
