Tricky Issues – Sickness, Annual Leave and the Working Time Regulations
The statutory provisions which entitle all workers to 5.6 weeks’ paid annual leave appear straightforward at first sight. However, managing the application of these rules to individual circumstances has, in fact, proved to be a significant headache for businesses over recent years. This has been caused, at least in part, by discrepancies which exist between the framework that operates in the UK and the requirements set at European level which continue to be interpreted by on-going case law in the European Court of Justice.
In this seminar we will consider how to manage some of the tricky issues which employers face in this area including managing sickness affected holiday, taking holiday during sick leave, carrying holiday forward, liability for holiday pay and entitlement of part-time workers and maternity absentees.
