Jon Chiam practises in the areas of commercial disputes, regulatory investigations and international arbitration. He has 9 years of experience acting for clients in the oil and gas, mining and information technology sectors, as well as advising Commonwealth and state government entities.

Jon has a strong understanding of each stage of the dispute resolution process and has assisted clients both in Australia and more broadly in the Asia-Pacific region in pursuing and protecting their interests through various forms of dispute resolution.

EXPERIENCE

Construction / Arbitration

  • Acting for a significant construction and engineering joint venture contractor in disputes arising out of the construction of an LNG plant and associated infrastructure, including a highly successful adjudication campaign securing payment of over AUD 200 million), as well as an international arbitration (Singapore seat) under the ICC Rules with the amount in dispute exceeding AUD1 billion.
  • Acting for a leading global information technology, consulting and business process services company in relation to disputes arising from the termination of two major IT services contracts in Australia, and similar contracts in Canada. Jon acted on two ICC arbitrations (Perth seat) and supported Canadian counsel in a Calgary-seated ICC arbitration, with a total amount in dispute exceeding AUD100 million.
  • Acting for a Swiss EPC contractor in Court proceedings arising from the construction of a waste to energy project, including in relation to defects, delay and disruption claims, with the amount in dispute exceeding AUD100 million.

Regulatory / Investigations

  • Advising the Office of the Australian Information Commissioner on its investigations into some of Australia’s largest and most high-profile data breaches, as well as civil penalty proceedings in relation to breaches of the Privacy Act.
  • Acting for an ASX-listed company in relation to an investigation by the Australian Federal Police with respect to purported breaches of an Australian sanctions regime.
  • Acting for an Australian company in relation to an investigation by the Australian Federal Police with respect to purported conduct of foreign bribery.
  • Acting for an Australian company in relation to an investigation by the Australian Securities and Investment Commission and subsequent civil penalty proceedings, with respect to purported contraventions of continuous disclosure obligations and misleading and deceptive conduct.

Corporate (Schemes of Arrangement, Insolvency and Administrations)

  • Acting for clients with respect to control transactions by scheme of arrangement, including:
    • Advising Strike Energy on its acquisition of Talon Energy (AUD143 million);
    • Advising Technology Metals Australia on its acquisition by Australian Vanadium (AUD84 million);
    • Advising Accel-KKR on its acquisition of K2fly (AUD38 million);
    • Advising TES Global on its acquisition of Schrole Group (AUD18 million);
    • Advising Viridian Financial Group on its acquisition by T.A. Associates LP (AUD308 million);
    • Advising SDI on its acquisition by Shandong Sinocera (AUD166 million);
  • Advising creditors in voluntary administrations.
