Marie is a Senior Associate in the firm's Litigation team, specialising in public law and procurement matters. Her practice includes handling numerous high-profile and complex cases.

In particular, Marie has acted for a wide variety of contracting authorities and utilities, as well as bidder clients, on procurement challenges and achieved successful outcomes, by way of negotiation, strike out/summary judgment and swift partial re-run.

EXPERIENCE

  • Advising seven local authorities (comprising Hartlepool Borough Council, Darlington Borough Council, Middlesbrough Borough Council, Redcar & Cleveland Borough Council, Stockton-on-Tees Borough Council, Newcastle City Council and Durham County Council (together the Authorities) in relation to a procurement challenge which has been commenced by Green Recovery Projects Limited (GRP) (HT-2024-000407) in relation to the Authorities decision to disqualify GRP from the procurement. The procurement relates to the design, build, operation and financing of an energy waste facility in the Tees Valley.
  • Acted for the successful applicant, Brookhouse Group Limited, in the Court of Appeal decision which was handed down on 28 June 2024. The case provides important clarification about the limitation periods which apply to claims seeking a declaration of ineffectiveness against public contracts under the PCRs [2024] EWCA Civ 717.
  • Acted for Birmingham City Council as one of the lead lawyers in its successful judicial review challenge to the decision of the Secretary of State for Transport to terminate the PFI Credits allocated to BCC’s 2.7bn£ highways PFI [2024] EWHC 1487 (Admin).
  • Supported an Interested Party, in respect of three applications which were issued by the contracting authority to lift an automatic suspension prohibiting the contracting authority and winning bidder from entering into a high value (potentially worth £bns) logistics contract.
  • Advised Ordnance Survey Limited in relation to a dispute which was commenced in the High Court of Justice, Business and Property Courts, Technology and Construction Court (under claim number HT- 2024-000351), arising out of a public procurement carried out by Ordnance Survey for the provision of Global Navigation Satellite System. The Defence was filed on 27 November 2024 and shortly thereafter the parties agreed to settle the dispute.
  • Advised a fund on a potential judicial review challenge to HMRC’s decision to refuse to grant it sovereign immunity in respect of liability to UK direct taxation.
  • Assisted, alongside the Government Legal Department, the Foreign, Commonwealth and Development Office in relation to the ongoing UK Covid-19 Inquiry, in particular, Marie assisted FCDO with disclosure and provision of evidence to the Inquiry.
  • Acted for Hitachi Rail Limited on a high value procurement challenge against London Underground Limited. Marie was involved in dealing with disclosure, witness evidence and expert evidence before the claim settled on confidential terms.
  • Acted for the Secretary of State for Transport in the 2019 Rail Franchising Litigation (a complex and high-value commercial judicial review claim).
  • Acted for NHS England and Public Health England in defence of a procurement challenge by Roche. The claim related to the competition to award a contract for the introduction of certain diagnostic testing. This matter involved complex disclosure issues, and the team also provided advice to NHS England after the case settled in respect of future procurements and detailed how procurement risks could be mitigated going forward.
