Independent Review of Administrative Law - Call for Evidence
The DLA Piper Public Law Team was recently invited to contribute to the Independent Review of Administrative Law (IRAL) by providing evidence to the IRAL Panel which has been appointed to consider options for reform to judicial review.
In their response, the DLA Piper Public Law Team express their concern that the call for evidence is premature, given that the legal profession is being asked for their input before any evidence has been made available of current problems existing in the judicial review system. The Public Law Team go on to explain why, in their view, judicial review is an essential part of a strong functioning democracy and any attempt to prevent the courts from holding the government to account would be unconstitutional. The Response then goes on to consider three possible areas for improvement of the system: a ‘track system’ to streamline claims; reform of how claims are funded, and clarification of the rules on standing.
