Wendy Novotne counsels a wide range of clients, from Fortune 500 to startup companies, on privacy compliance, cyber security, and data governance matters. In particular, Wendy has in-depth institutional knowledge of the automotive, retail, media, technology, and consumer financial services industries.

Wendy's practice reflects her unique perspective and background working as an in-house attorney, at the California AG's Office, and as a core member of DLA Piper's top-ranked, innovative data privacy and cybersecurity practice group. With over a decade of experience, Wendy's advice and guidance is practical, strategic, actionable, and tailored to a client's size, business model, future plans, and risk profile.

Wendy's client support includes the following:

  • Serving on secondment for a key firm client in the global automotive industry
  • Developing and assisting clients with the implementation of privacy compliance plans
  • Helping clients develop and maintain all aspects of their privacy and compliance related functions, including policies and procedures, consumer-facing notices and consents, data processing agreements, and other related artifacts
  • Helping clients manage incident response matters, including engaging vendors and experts, overseeing forensic investigations, notification reporting, internal communications, and manage post-incident liability
  • Monitoring and response to global privacy developments and legislative changes
  • Providing product counseling and conducting product reviews, including advising on privacy impact assessments, strategy and risk mitigation, and design and implementation of privacy controls
  • Negotiating privacy and security terms and agreements
  • Assisting with preparation for and responding to regulatory privacy audits
  • Conducting privacy due diligence reviews related to acquisitions, asset sales, and other corporate transactions

She also routinely works on pro bono matters related to privacy and data security.

Outside the office, Wendy was appointed by Seattle's mayor to serve on the Community Surveillance Working Group to advice Seattle's City Council and the Mayor's Office on matters of privacy and surveillance technology.

Pro Bono

Wendy regularly helps non-profit clients with drafting their privacy policies and advising on their privacy and data security compliance programs. Additionally, Wendy has helped clients seeking asylum in conjunction with Human Rights First, a non-profit, nonpartisan international human rights organization based in New York, Washington, DC, Houston, and Los Angeles.

Prior Experience

Before joining DLA Piper, Wendy was an Associate at a national law firm where she counselled clients, primarily financial service providers, on consumer financial services, privacy and data security, and mortgage banking. Wendy also worked in-house at one of the largest national independent mortgage lenders and helped ensure the company was in compliance with applicable state and federal laws and regulations, particularly involving financial services, consumer protection, and privacy and data security.

After graduating law school, Wendy worked as a fellow for the California Monitor Program, a program developed by former California Attorney General Kamala Harris, to oversee the implementation of the landmark US$25 billion National Mortgage Settlement. During law school, Wendy was a certified legal intern at the Notre Dame Legal Aid Clinic, and represented consumers in financial services matters and mediated cases. She also served as a judicial extern to Justine Mary Yu and Justice Steven Gonzalez of the Washington Supreme Court. Prior to law school, Wendy mediated and negotiated cases involving contract, small business, small claims, family law, and insurance claims issues.
