With years of experience advising organizations on cutting-edge privacy and data protection issues as well as workplace compliance, Carly is uniquely positioned to help businesses navigate the complexities of data privacy and modern employment practices.
As co-lead of the firm’s Québec privacy and data protection group, Carly advises clients on all aspects of complying with the robust privacy and data protection laws applicable at the federal and provincial level in Québec. She has extensive experience developing and drafting privacy and confidentiality procedures and policies, negotiating data-processing agreements and cross-border transfers, and guiding businesses through data breaches and enforcement actions. She has significant experience assisting clients with the management and reporting of confidentiality incidents and cybersecurity data breaches, including with coordinating incident response across several jurisdictions.
Given her experience in this area, Carly has served as privacy counsel in the context of class action litigation resulting from material data breaches and confidentiality incidents.
In the employment law arena, Carly provides comprehensive guidance on workforce management, such as complying with employment standards and regulations, handling sensitive workplace investigations, navigating disputes, and addressing privacy issues related to employment, including employee monitoring, automated decision making, and the implementation of biometric systems within the workplace.
In particular, Carly’s employment practice consists of representing employers on all aspects of management-side employment matters and any related litigation. This includes employee hiring and termination, performance and discipline management, the drafting and implementation of employment agreements and workplace policies, and advising on applicable health and safety legislation, as well as compliance with Québec’s French language requirements. Carly also assists clients with conducting workplace investigations, including harassment investigations.
Carly has acted as lead employment and privacy counsel in many complex M&A transactions and is recognized for her ability to provide timely and strategic industry-specific advice.
By leveraging deep expertise across both practice areas, Carly delivers tailored, forward-thinking solutions that address the challenges of today’s interconnected and regulated business landscape.
