Abigail works in DLA Piper’s Construction, Engineering and Infrastructure Disputes team, providing both operational and dispute resolution advice. 

She advises on high value, complex disputes on major infrastructure and engineering projects in a range of sectors, providing advice on all aspects of contentious construction law. In addition to providing pre-dispute / dispute avoidance advice on live projects, Abigail has experience of litigation and alternative dispute resolution including adjudication and mediation. 

Abigail has experience of the many forms of standard contract used in the UK (including NEC and JCT) as well as bespoke contracts and PPP/PFI contracts, and has acted for a range of clients including procuring authorities, employers (public and private), main contractors and specialist contractors.

EXPERIENCE

  • Advised an incorporated joint venture on claims arising out of major civils works at an operational UK Port.
    • Provided advice regarding the nature and extent of the client’s obligations to a third party and strategic advice on the management of various stakeholders to ensure progression of the project.
    • Provided advice in respect of various contractual claims regarding the assessment of Compensation Events under an amended NEC3 contract. Advice included drafting several notices for escalation through the contractual dispute resolution procedure and representing the client in adjudication (in which our client was ultimately successful).
  • Advised a UK water company in a GBP20+ million claim against a series of framework contractors relating to a systemic defect in the design of several tertiary treatment plants designed and constructed under NEC3 contracts. Issues arising related to civil engineering, concrete technology and process engineering. Claims were made against 12 different contracting parties under Framework Agreements and involved complex issues surrounding limitation under the Latent Damage Act 1986. The claims settled at a two-day, multi-party mediation.
  • Advised a local authority on claims arising from a landmark PPP Infrastructure Project. Issues arising included compensation event and relief event claims and matters of contractual and statutory interpretation.
  • Advised a government-owned company on a final account claim for a major road development project. Advice related to several compensation event claims and included preparation of the claim for mediation and adjudication.
  • Advised a main contractor on claims arising out of civils works at a UK airport. Provided strategic support including the preparation and management of various claims relating to the assessment of Compensation Events under an amended NEC3 contract.
