Kevin Yeung has an extensive dispute resolution practice that covers contentious financial regulatory matters and commercial disputes.

Kevin regularly advises listed companies, licensed corporations and their senior executives in contentious regulatory matters, including in investigations, enforcement actions, and resulting civil and white-collar criminal proceedings initiated by the Securities and Futures Commission (SFC) and other regulatory authorities.

In addition, Kevin maintains a general commercial disputes practice that covers misconduct allegations brought against financial institutions, international arbitration and corporate insolvency.

Kevin was recently seconded to a major Chinese insurer to advise on the restructuring of a distressed private equity investment in the education sector.

Kevin is a dual-qualified solicitor in both Hong Kong and England & Wales.

EXPERIENCE

  • Defending directors of listed companies in SFC-initiated director disqualification proceedings, including in SFC v Zhou Ling [2024] HKCFI 2484, the first case in over a decade where the SFC failed to establish its case at trial. Also experienced in resolving proceedings through the Carecraft procedure.
  • Advising multiple listed companies, licensed corporations and their senior executives in dealing with SFC/HKMA/ICAC investigations, interviews, disciplinary actions, as well as routine intermediary inspections and compliance reviews. Matters handled include bribery allegations, breach of U.S. regulations, due diligence failures, internal control deficiencies and unauthorized advertisement of investment products.
  • Defending a multinational bank in mis-selling claims involving accumulators, foreign exchange derivatives, and vulnerable customers.
  • Defending a precious metals trader in a representative action brought by over 1,300 individuals alleging a fraudulent investment scheme.
  • Acting for a charity on its independent investigation into allegations of corrupt fundraising practices.
  • Advising a construction main contractor in licensing disputes with the Hong Kong government.
  • Acting for a PRC financial institution in an application to set aside an interim arbitral award on jurisdiction, which remains the landmark case in HK dealing with compatibility of different arbitration Agreements.
  • Representing a PRC-listed oil and gas company in an LCIA arbitration on disputes arising from the acquisition of a Trinidad oilfield.
  • Advising the liquidators of a formerly listed company in Hong Kong on their creditor-opposed application for recognition of Bermuda soft-touch liquidation and stay of winding-up proceedings.
