
Shu Ying Chua
Senior AssociateShu Ying is an employment and investigations lawyer. She advises on employment matters covering the whole lifecycle of the employment relationship, employment investigations, business restructurings, reductions in force, and employment aspects of corporate transactions.
With experience advising on employment issues in both private practice and in-house settings, she has a strong understanding of business considerations. She provides clients commercial solutions which are legally compliant, and takes into account practical business needs and cultural sensitivities.
Her practice covers a broad range of employment matters including employment documents and policies reviews, performance management, workplace safety issues, employee equity grants, harassment and discrimination, union and industrial relations, business restructurings, reductions in force and terminations.
She is also experienced in investigations – both internal employee investigations and external regulatory investigations. She has helped clients manage investigations and audits by labour authorities, and secure favourable outcomes.
EXPERIENCE
- Advised various multinational companies on wrongful dismissal and salary-related claims before the Employment Claims Tribunal. Provided strategic advice in pre-hearing negotiations, mediations, hearing preparation and settlements.
- Advised various multinational companies (tech, financial services, private equity) on structuring restrictive covenants with a view to maximise chances of enforcement.
- Advised various multinational companies on the upcoming Workplace Fairness Act, preparation of harassment, discrimination and grievance polices in line with the upcoming requirements.
- Advised various multinational companies on the employment and immigration aspects of their business expansion to Singapore, including entity setup, hiring structures and preparing key employment documents.
- Advised a multinational pharmaceuticals company in an internal investigation and dismissal of a senior employee, involving sensitive issues of conflict of interests and financial fraud amounting to a 7-figure sum.
- Advised a leading bank on a regulatory investigation by the Ministry of Manpower for discriminatory employment practices and breaches of Tripartite Guidelines on Fair Employment Practices, and successfully securing a lower penalty.*
- Advised a multinational company on a regulatory investigation by the Central Provident Board regarding shortfall in social security contributions and related breaches of law.*
- Advised a leading petrochemical company on the employment and immigration aspects of its divestment of a core business involving complex employee transfers, trade unions, immigration and pensions issues.*
- Advised a leading renewables company on its business acquisition worth over SGD 1bn in connection with the employment and immigration aspects of the transaction.*
- Advised a gaming company on equity grants, prepare employee share options plan and grant documents.*
- Advised a leading tech company in its restructuring and global redundancy exercise, coordinated and prepare execution handbooks and documents for APAC jurisdictions.*
