About

Josefa Larraín’s practice focuses on civil litigation and arbitration, with extensive experience advising clients on their judicial and commercial strategies in disputes related to energy, finance, business restructuring, company acquisitions, real estate, health insurance, and retail, among others.

Some of her notable work includes: representing a major telecoms company in a International Centre for Settlement of Investment Disputes (CIADI) investment arbitration against the State of Chile; representing a major construction and power generation developer in international arbitration and before a dispute adjudication board; defending a major sports and entertainment company in a commercial arbitration for breach of a license agreement with a multinational company; representing various retail, financial services and brokerage companies in class action lawsuits initiated by the National Consumer Service.

Josefa has participated in commercial and investment arbitrations under the main international rules (ICC, ICSID, UNCITRAL, CAM/CCBC, among others).

  • A major telecommunications company in obtaining precautionary measures in the framework of investment arbitration against the State of Chile in what was a unique milestone in the history of our country, granting a precautionary measure prior to the start of the negotiation stage with the State
  • A major developer of construction and energy generation projects in an international arbitration before the ICC and a Dispute Adjudication Board
  • A major retail company in arbitration proceedings arising from the merger and acquisition with other retail companies. Also, represented the same company in various civil and arbitration lawsuits associated with the termination of leases of commercial premises that did not comply with market conditions
  • A leading Chilean university in a series of class action and civil lawsuits filed throughout the country related to misleading advertising of two new degree programs offered by the university
  • An inherited estate in the defense of various pre-trial injunctions, arbitrations, and civil lawsuits against the legatee of the will
  • One of the largest insurance companies in the country in the defense of various civil lawsuits, arbitrations, and appeals for protection brought by policyholders and beneficiaries. The insurance company has been acquitted in most cases
  • A major pioneering energy company in the arbitration for breach of energy contracts and damages arising therefrom. Obtained an unprecedented judgment that allowed our client to be excluded from arbitration
  • A major sports and entertainment company in international arbitration for breach of a licensing agreement with a multinational company
  • Several retail, financial services, and brokerage companies in various class actions brought by the National Consumer Service
