Joshua (Josh) Elefant represents and advises employers on a broad range of employment and labor law matters, including corporate transactions, day-to-day employment counseling, and litigation.

His counseling practice includes advising on any and all matters that employers may encounter, such as hiring and separations, drafting and negotiating executive employment agreements, workplace policies, commission and bonus plans, investigations, whistleblower, harassment, discrimination, and retaliation complaints, and wage and hour compliance.

In his litigation practice, Josh represents clients in single-plaintiff and class action matters. He also represents clients before administrative agencies, including the California Labor Commissioner, the California Civil Rights Department, the US Department of Labor, and the US Equal Employment Opportunity Commission. He has extensive experience across all phases of litigation, including taking depositions of plaintiffs and witnesses, defending depositions of company executives and board members, motion practice (including motions to compel arbitration, protective orders, and motions for summary judgment or adjudication), trial, and arbitration.

In the transactional context, Josh works on buy-side and sell-side transactions ranging from multi-million- to billion-dollar deals. His experience includes conducting pre-acquisition due diligence, preparing and negotiating definitive transaction agreements, advising on employee integration strategies and communications, and drafting employment agreements and related ancillary documents, including non-compete and retention agreements.

Prior Experience

During law school, Josh externed for Judge Leslie G. Landau of the Superior Court for the County of Contra Costa. Prior to law school, Josh worked as a workers’ compensation claims manager.
