Bing "Sunny" Sun advises multinational companies in high-stakes disputes, government investigations and inquiries, internal investigations, as well as compliance matters.

Sunny has extensive experience in commercial litigation on complex claims regarding fraud, breach of contract, unfair competition, and violations of state and federal statutes. Her experience encompasses cases in both federal and state courts through all phases of trial, arbitration, and mediation.

Sunny has represented companies and individuals before the Securities and Exchange Commission (SEC), Department of Justice (DOJ), and other federal and state enforcement authorities on matters related to the Foreign Corrupt Practices Act (FCPA), accounting and securities fraud, and other civil and criminal matters. Further, Sunny regularly provides regulatory and compliance advice to clients. 

Sunny has represented corporations, executives, and board members across a wide range of industries, including consumer goods, technology, media, pharmaceutical, finance, telecom, healthcare, investment management, energy, insurance, and manufacturing.

EXPERIENCE

  • Defended energy company in class action alleging deceptive pricing and consumer marketing practices and obtained dismissal of all claims.
  • Represented Plaintiff-Seller in expedited litigation in Delaware Chancery Court against Defendant-Buyer in earnout dispute, resulting in favorable settlement for client a week before trial.
  • Represented a Chinese internet technology company in an internal investigation regarding an allegation that an employee had engaged in a scheme to defraud the company.
  • Represented a Chinese consumer product company in an internal investigation regarding whistleblower allegations against a C-level executive relating to business and management misconduct.
  • Represented a public US financial company in an internal investigation of its compliance with Federal Deposit Insurance Corporation requirements.
  • Represented the audit committee of a public US food distribution company in an SEC investigation of alleged securities violations.
