Allen Waxman

Of Counsel

With over 35 years of experience in the courtroom, boardroom, and ADR venues, Allen Waxman has been a trial lawyer, national counsel in mass tort cases, counselor to the C-suite and boards, and the CEO of a dispute resolution organization.  

Allen was the head of litigation and General Counsel of Pfizer, the General Counsel and a business unit leader of Market Access at Eisai (a Japanese-based pharma company), and General Counsel of Roivant Sciences, a biotech startup.  He most recently led the International Institute for Conflict Prevention and Resolution (CPR), a not-for-profit comprised of corporate, law firm and other members from around the world, focusing on dispute management across industry sectors, such as healthcare and life sciences, energy, oil and gas, insurance, and technology. CPR developed tools for more effective, efficient ways to resolve disputes and prevent them where possible and provided mediation, arbitration, and other ADR services. 

Previously, Allen was a partner at two prominent law firms where he led trial teams, served as national counsel in pharmaceutical product liability cases, developed and led compliance diagnostics and risk management reviews, and executed dispute resolution strategies.

  • Served as National Counsel or Head of Litigation for multiple mass tort litigations. 
    • Established virtual law firms and led trial teams in the Norplant and Fen-Phen litigations.
    • Acted as national counsel and head of regulatory witness preparation team in the Baycol litigation.
    • Oversaw Rezulin, Neurontin and COX-2 multi-dimensional litigations, including products liability, consumer fraud and AG actions, and developed successful resolution strategies.  
    • Co-led resolution strategies for the HRT litigation and successfully executed on multiple negotiations to resolve the litigation. 
  • Oversaw successful IP litigations for Lipitor and Aloxi extending the lifecycle of these significant products.
  • Led commercial, manufacturing and R&D compliance diagnostics for various life sciences companies, evaluating risks and refining controls.
  • Designed strategies and negotiated contracts for achieving at least parity placement for obesity, epilepsy (Part D) and oncology (Part B) medicines on formularies.
  • Designed governance models for biotech company’s multiple subsidiaries to support freedom to operate within focused business areas while ensuring effective oversight.
  • Developed compliance for corporate, healthcare, data privacy and security, and HR programs across biotech enterprise.
  • Drove passage of “Improving Regulatory Transparency for New Medical Therapies Act,” reforming regulatory process for medicines subject to DEA scheduling.
  • Led drafting of Principles, Protocols and Procedures for administration of dispute resolution at CPR Dispute Resolution Services.
  • Led team of in-house and outside counsel in preparing a Manual on Mitigating Risk in Life Sciences Transactions, examining key clauses in licensing agreements and how they might better be deployed to support the goals of the transaction.
  • Adopted new Diversity, Equity and Inclusion platform, known as the Ray Corollary Initiative, to drive more diverse deployment of arbitrators and mediators at CPR Dispute Resolution Services.
  • Designed a protocol for resolving mass employment-related claims, which received endorsement from the United States District Court for the Northern District of California.
  • Launched a Pledge for Dispute Prevention in Business Relationships, developing mechanisms to identify conflict early and address it before it becomes a costly dispute.
  • Trained as an arbitrator, mediator and ombudsman.
