Managing the eDiscovery Process
DLA Piper’s eDiscovery and Information Management group is experienced in all facets of the eDiscovery process, including:
- review and analysis
Our services include development of litigation hold notices and protocols; finding solutions to mitigate costs related to identification, collection and storage of data; and counseling on strategies for reducing the overall dataset to review for ultimate production. We also identify vendor tools that work most efficiently with specific client systems.
For the review process, we employ culling strategies and advanced technology, including technology assisted review, to isolate relevant data. We also have the ability to store data internally on secure servers, which decreases the cost of the eDiscovery process for our clients. Another means by which we ensure consistency and limit costs is our use of contract lawyers specifically trained to review and code electronically stored information (ESI).
Records and Information Management
DLA Piper’s eDiscovery and Information Management group includes dedicated Records and Information Management (RIM) practitioners. The RIM team has as its foundation a network of lawyers experienced with records retention requirements around the world across a range of industries. The RIM team has established a methodology for the development of records and information management programs to include RIM policies and procedures, records retention schedules, training, implementation and audit. The data, research and templates developed to support this methodology serve as the foundation of our assessment of legal compliance globally.
We regularly advise clients with respect to the development of a consistent RIM strategy, based upon legal requirements and best practices, which are customized to the client’s core business operations. We endeavor to help our clients proactively implement a defensible business strategy and avoid the risks and costs associated with the overall lack of an appropriate RIM program, or the failure of its enforcement.
Foreign Data Privacy
The eDiscovery and Information Management group addresses foreign data privacy issues on a regular basis and often coordinates with our Privacy practice on these issues. Our practitioners regularly oversee the transfer of data pursuant to data privacy regulations. This is often done in conjunction with DLA Piper colleagues in international offices. We also work with our clients to implement policies and procedures for the processing, collection and transfer of data subject to foreign data privacy laws.
Our practitioners consult clients outside of the litigation context and provide consultation and training on a variety of litigation readiness topics, including litigation hold processes and procedures. We work with clients to put them in the most defensible position before litigation or investigation is a reality. This includes counseling clients on best practices, drafting or revising policies and procedures, and training on all aspects of eDiscovery and information management. We assist in developing policies and procedures that incorporate best practices in the field while simultaneously yielding cost savings.
Litigation Support Team
In addition to our team of attorneys, the eDiscovery and Information Management practice is supported by a team of litigation support professionals across the US. These members of the team are highly experienced in all aspects of eDiscovery and regularly support our case teams with data collection consulting, vendor selection, ESI processing and production. Having this in-house team allows us to provide our clients with consultation and technical work, and to do so in the most cost-efficient manner.
